S.F. _____ Section 1. Section 123.56, subsection 2, Code 2015, is 1 amended to read as follows: 2 2. Native wine may be sold at retail for off-premises 3 consumption when sold on the premises of the manufacturer, 4 or in a retail establishment operated by the manufacturer , 5 or at a location and with the permission of a licensee or 6 permittee issued a five-day license pursuant to section 123.34 . 7 Sales may also be made to class “A” or retail wine permittees 8 or liquor control licensees as authorized by the class “A” 9 wine permit. A manufacturer of native wines shall not sell 10 the wines other than as permitted in this chapter and shall 11 not allow wine sold to be consumed upon the premises of the 12 manufacturer. However, prior to sale native wines may be 13 sampled on the premises where made, when no charge is made 14 for the sampling. A person may manufacture native wine for 15 consumption on the manufacturer’s premises, when the wine or 16 any part of it is not manufactured for sale. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill allows the sale of native wines at retail for 21 off-premises consumption at a location and with the permission 22 of a licensee or permittee issued a five-day license pursuant 23 to Code section 123.34. 24 -1- LSB 1713XC (2) 86 ec/nh 1/ 1
