S.F. _____ H.F. _____ Section 1. Section 8D.9, subsection 3, Code 2015, is amended 1 by striking the subsection. 2 Sec. 2. Section 8D.13, subsection 18, Code 2015, is amended 3 to read as follows: 4 18. Access to the network shall be offered to the department 5 of public safety , and the department of public defense , and the 6 department of homeland security and emergency management for 7 the purpose of establishing and operating a shared data-only 8 secure statewide network providing law enforcement, emergency 9 management, disaster service, emergency warning, and other 10 emergency information dissemination services to federal, state, 11 and local law enforcement agencies as provided in sections 80.9 12 and 80.9B , and local emergency management offices established 13 under the authority of sections 29C.9 and 29C.10 , and the 14 department of homeland security and emergency management . 15 Sec. 3. Section 8D.13, Code 2015, is amended by adding the 16 following new subsection: 17 NEW SUBSECTION . 18A. Access to the network shall be 18 offered to local emergency management offices for the purpose 19 of providing a secure statewide communications network to 20 facilitate more effective emergency response services and 21 to protect the health, safety, and welfare of the people of 22 this state. A local emergency management office shall be 23 responsible for all costs associated with the connection to and 24 the use of the network, excluding any costs associated with 25 access provided through the department of homeland security and 26 emergency management as provided under subsection 18. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill allows access to the Iowa communications network 31 to local emergency management offices for the purpose of 32 establishing and operating a secure statewide network to 33 facilitate more effective emergency responses. The bill 34 provides that the local emergency management office is 35 -1- LSB 1167DP (3) 86 ad/sc 1/ 2

The bill also adds a reference to the department 2 of homeland security and emergency management regarding access 3 to the network. 4 The bill eliminates a provision relating to restrictions 5 of certain public agencies to access the Iowa communications 6 network solely for homeland security communication purposes 7 and disaster communication purposes and only upon a state of 8 disaster emergency proclaimed by the governor. 9 -2- LSB 1167DP (3) 86 ad/sc 2/ 2
