S.F. _____ H.F. _____ Section 1. Section 602.1501, Code 2015, is amended by 1 striking the section and inserting in lieu thereof the 2 following: 3 602.1501 Judicial salaries. 4 1. The salaries provided for in this section shall be paid 5 from funds allocated to the judicial branch from the salary 6 adjustment fund in section 8.43, or if the allocation is not 7 sufficient, from funds appropriated to the judicial branch. 8 a. The chief justice of the supreme court shall receive the 9 salary set by the general assembly. 10 b. All justices of the supreme court other than the chief 11 justice shall receive the same salary as set by the general 12 assembly. 13 c. The chief judge of the court of appeals shall receive the 14 salary set by the supreme court. 15 d. All judges of the court of appeals other than the chief 16 judge shall receive the same salary as set by the supreme 17 court. 18 e. The chief judges of all judicial districts shall receive 19 the same salary as set by the supreme court. 20 f. All district judges shall receive the same salary as set 21 by the supreme court. 22 g. All district associate judges shall receive the same 23 salary as set by the supreme court. 24 h. All full-time associate juvenile judges and all full-time 25 associate probate judges shall receive the same salary as set 26 by the supreme court. 27 i. All magistrates shall receive the same salary as set by 28 the supreme court, subject to section 602.6402. 29 j. All senior judges shall receive the same salary as set by 30 the supreme court, subject to section 602.9204. 31 2. This section is effective for the fiscal year beginning 32 July 1, 2016, and for every fiscal year thereafter until 33 otherwise provided by the general assembly. 34 Sec. 2. A judge to whom this article applies shall be paid an 2 amount equal to the basic salary of the judge as set by the 3 general assembly pursuant to section 602.1501 reduced by an 4 amount designated as the judge’s required contribution to the 5 judicial retirement fund. The amount designated as the judge’s 6 required contribution shall be paid by the state in the manner 7 provided in subsection 2 . 8 Sec. 3. Section 602.9204, subsection 1, paragraph a, Code 9 2015, is amended to read as follows: 10 a. A judge who retires on or after July 1, 1994, and who is 11 appointed a senior judge under section 602.9203 shall be paid a 12 salary as determined by the general assembly set pursuant to 13 section 602.1501 . 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to judicial salaries. The bill specifies 18 that salaries for the justices of the supreme court shall 19 continue to be set by the general assembly, and specifies that 20 salaries for the judges of the court of appeals, district 21 judges, district associate judges, associate juvenile judges, 22 associate probate judges, magistrates, and senior judges shall 23 be set by the supreme court. The bill further specifies that 24 the salaries shall be paid from funds allocated to the judicial 25 branch from the salary adjustment fund in Code section 8.43, or 26 if the allocation is not sufficient, from funds appropriated 27 to the judicial branch. 28 Under current law, judicial salaries are set by the general 29 assembly.
