Section
1.
Section
34A.8,
subsection
1,
Code
2015,
is
1
amended
to
read
as
follows:

1.
A
local
exchange
service
provider
shall
furnish
to
the
3
E911
service
provider,
designated
by
the
joint
E911
service
4
board,
all
names,
addresses,
and
telephone
number
information
5
concerning
its
subscribers
which
will
be
served
by
the
E911
6
system
and
shall
periodically
update
the
local
exchange
service
7
information.
The
E911
service
provider
shall
furnish
this
8
data
to
the
director
for
use
in
the
mass
notification
and
9
emergency
messaging
system
as
defined
in
section
29C.2.
The
10
local
exchange
service
provider
shall
receive
as
compensation
11
for
the
provision
of
local
exchange
service
information
charges
12
according
to
its
tariffs
on
file
with
and
approved
by
the
Iowa
13
utilities
board.
The
tariff
charges
shall
be
the
same
whether
14
or
not
the
local
exchange
service
provider
is
designated
as
the
15
E911
service
provider
by
the
joint
E911
service
board.

Section
34A.8,
subsection
2,
paragraph
b,
Code
2015,
17
is
amended
to
read
as
follows:

b.
The
director,
program
manager,
joint
E911
service
board,
19
local
emergency
management
commission
established
pursuant
to
20
section
29C.9,
the
designated
E911
service
provider,
and
the
21
public
safety
answering
point,
their
agents,
employees,
and
22
assigns
shall
use
local
exchange
service
information
provided
23
by
the
local
exchange
service
provider
solely
for
the
purposes
24
of
providing
E911
emergency
telephone
service
or
providing
25
related
911
call
alert
mass
notification
and
emergency
26
messaging
services
as
described
in
section
29C.17A
utilizing
27
only
the
subscriber’s
information
to
a
subscriber
who
consents
28
to
the
provision
of
such
services
,
and
it
shall
otherwise
be
29
kept
confidential.
A
person
who
violates
this
section
is
30
guilty
of
a
simple
misdemeanor.

does

constitute
agreement
with

the
members

general

bill
requires
an
E911
service
provider
to
provide

number
information
concerning

its
subscribers
served
by
the
E911
system
to
the
director
of

the
department
of
homeland
security
and
emergency
management

to
use
in
the
mass
notification
and
emergency
messaging

system.
The
bill
adds
the
director
of
the
department
of
5
homeland
security
and
emergency
management
and
local
emergency
6
management
commissions
to
the
list
of
persons
and
entities
that
7
must
use
this
information
solely
for
the
purposes
of
providing
8
E911
emergency
telephone
service
or
providing
mass
notification
9
and
emergency
messaging
services.
The
bill
eliminates
language
10
limiting
use
of
this
subscriber
information
to
information
11
about
a
subscriber
that
consents
to
the
services.
Current
12
law
provides
that
this
information
is
confidential
and
that
a
13
violation
of
such
provisions
is
a
simple
misdemeanor.
14
The
bill
replaces
the
term
“911
call
alert”
with
“mass
15
notification
and
emergency
messaging
services”.
