NEW SECTION . 148.8A Relinquishment of a license 1 —— failure to renew or reinstate. 2 A person’s license to practice medicine and surgery or 3 osteopathic medicine and surgery shall be deemed relinquished 4 if the person fails to apply for renewal or reinstatement of 5 the license within five years after its expiration. A license 6 shall not be reinstated, reissued, or restored once it is 7 relinquished. The person may apply for a new license pursuant 8 to section 148.3 and applicable administrative rules. 9 Sec. 2. NEW SECTION . 148.11A Administrative medicine 10 license. 11 1. As used in this section: 12 a. “Administrative medicine” means administration or 13 management utilizing the medical and clinical knowledge, skill, 14 and judgment of a person licensed to practice medicine and 15 surgery or osteopathic medicine and surgery and capable of 16 affecting the health and safety of the public or any person. 17 b. “Administrative medicine license” means a license issued 18 by the board pursuant to this section. 19 2. An application for an administrative medicine license 20 shall be made to the board. An applicant for an administrative 21 medicine license shall meet all of the requirements established 22 in section 148.3 and any additional requirements established by 23 the board by rule. The board shall also adopt rules governing 24 the initial issuance and renewal of administrative medicine 25 licenses and establishing fees therefor. All license and 26 renewal fees shall be paid to the board. 27 3. a. A physician with an administrative medicine license 28 may do any of the following: 29 (1) Advise public or private organizations on health care 30 matters. 31 (2) Authorize or deny payments for care. 32 (3) Organize or direct research programs. 33 (4) Review care provided for quality. 34 (5) Perform other similar duties that do not require direct 35 -1- LSB 1193DP (4) 86 tr/nh 1/ 3

An administrative medicine license does not convey the 2 authority to do any of the following, unless the person is 3 otherwise licensed to perform such duties: 4 (1) Practice clinical medicine. 5 (2) Examine, care for, or treat patients. 6 (3) Prescribe medications including controlled substances. 7 (4) Delegate medical acts or prescriptive authority to 8 others. 9 4. A person issued an administrative medicine license is 10 subject to the same laws and rules governing the practice of 11 medicine as a person issued a license to practice medicine and 12 surgery or osteopathic medicine and surgery under this chapter 13 unless otherwise provided by the board by rule. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill establishes a process by which a physician’s 18 license shall be deemed relinquished. Under the bill, a 19 physician’s license is deemed relinquished when the physician 20 fails or declines to apply for renewal or reinstatement of the 21 license for five years. Once a license is relinquished, it 22 cannot be renewed, reinstated, or restored. A physician whose 23 license is relinquished may apply to the board of medicine for 24 a new license. 25 The bill creates an “administrative medicine license” for 26 physicians who engage in nonclinical practice. Under the 27 bill, a physician with an administrative medicine license 28 may advise organizations, authorize or deny payments for 29 care, organize and direct research programs, review care, and 30 perform other duties not requiring direct patient care. An 31 administrative medicine license does not allow a physician to 32 practice clinical medicine, treat patients, prescribe drugs or 33 controlled substances, or delegate authority unless otherwise 34 licensed to do so. 35 -2- LSB 1193DP (4) 86 tr/nh 2/ 3
S.F. _____ H.F. _____ The bill requires that applicants to the board of medicine 1 seeking an administrative medicine license meet requirements 2 established for those seeking to practice medicine under Code 3 section 148.3 and any other requirements established by the 4 board by rule.
