Senate Resolution 114 - Introduced SENATE RESOLUTION NO. 114 BY CHELGREN , ZAUN , SCHULTZ , ROZENBOOM , and SCHNEIDER A Resolution urging Congress and the President of the 1 United States to reclassify cannabis as a schedule 2 II controlled substance under the United States 3 Controlled Substances Act to facilitate research 4 and testing on the potential benefits of medical 5 cannabis. 6 WHEREAS, while Iowa and twenty-two other states and 7 the District of Columbia have enacted laws allowing 8 the regulated use of medical cannabis for numerous 9 debilitating medical conditions, cannabis use remains 10 illegal under the United States Controlled Substances 11 Act; and 12 WHEREAS, cannabis is currently classified by 13 the federal Drug Enforcement Agency as a schedule I 14 controlled substance under the United States Controlled 15 Substances Act, a classification that impedes 16 large-scale medical and scientific research on the 17 effects of cannabis; and 18 WHEREAS, a schedule I controlled substance is a 19 highly addictive substance that has no accepted medical 20 use in the United States and a schedule II controlled 21 substance is a highly addictive substance that has an 22 accepted medical use in the United States; and 23 WHEREAS, substances classified as a schedule 24 II controlled substance may be dispensed with a 25 prescription under certain circumstances and are 26 subject to large-scale research, testing, and 27 manufacturing; and 28 -1- LSB 6070XS (2) 86 rh/rj 1/ 3

S.R. 114 WHEREAS, there is a significant lack of medical and 1 scientific research on medical cannabis by industries, 2 universities, research institutions, and federal 3 agencies including but not limited to the food and drug 4 administration in the United States due in part to 5 the fact that cannabis is classified as a schedule I 6 controlled substance; and 7 WHEREAS, the United States Surgeon General’s 8 reports on the health consequences of tobacco use in 9 the United States over a 50-year period are based on 10 scientifically rigorous reviews and analyses of data 11 on the prevalence, causes, effects, and implications 12 of tobacco use in the United States and reclassifying 13 cannabis as a schedule II controlled substance 14 would allow for a similar rigorous scientific review 15 of clinical research and testing by industries, 16 universities, research institutions, and federal 17 agencies on the potential benefits of medical 18 cannabis; NOW THEREFORE, 19 BE IT RESOLVED BY THE SENATE, That the Iowa Senate 20 respectfully urges the Congress of the United States 21 to enact legislation to reclassify cannabis as a 22 schedule II controlled substance under the United 23 States Controlled Substances Act to facilitate research 24 and testing on the potential benefits of medical 25 cannabis; and 26 BE IT FURTHER RESOLVED, That an official copy of 27 this resolution be transmitted to the President of 28 the United States, the Surgeon General of the United 29 States, the President and Secretary of the United 30 -2- LSB 6070XS (2) 86 rh/rj 2/ 3
