UNCLAIMED PARI-MUTUEL WAGERING WINNINGS —— 32 HORSE AND DOG RACING. DAIRY REGULATION. 28 1. There is appropriated from the general fund of the state 29 to the department of agriculture and land stewardship for the 30 fiscal year beginning July 1, 2015, and ending June 30, 2016, 31 the following amount, or so much thereof as is necessary, to be 32 used for the purposes designated: 33 For purposes of performing functions pursuant to section 34 192.109 , including conducting a survey of grade “A” milk and 35 -2- LSB 2649SV (3) 86 da/rn 2/ 43

LOCAL FOOD AND FARM PROGRAM. 8 1. The department shall enter into a cost-sharing agreement 17 with Iowa state university of science and technology to support 18 the local food and farm program coordinator position as part of 19 the university’s cooperative extension service in agriculture 20 and home economics pursuant to chapter 267A . 21 3. Notwithstanding section 8.33 , moneys appropriated in 22 this section that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available to be used for the purposes designated until the 25 close of the succeeding fiscal year. 26 Sec. 6. AGRICULTURAL EDUCATION. 27 1. There is appropriated from the general fund of the state 28 to the department of agriculture and land stewardship for the 29 fiscal year beginning July 1, 2015, and ending June 30, 2016, 30 the following amount, or so much thereof as is necessary, to be 31 used for the purposes designated: 32 For purposes of allocating moneys to an Iowa association 33 affiliated with a national organization which promotes 34 agricultural education providing for future farmers: 35 -3- LSB 2649SV (3) 86 da/rn 3/ 43

FARMERS WITH DISABILITIES PROGRAM. 8 1. There is appropriated from the general fund of the state 9 to the department of agriculture and land stewardship for the 10 fiscal year beginning July 1, 2015, and ending June 30, 2016, 11 the following amount, or so much thereof as is necessary, to be 12 used for the purposes designated: 13 For purposes of supporting a program for farmers with 14 disabilities: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 130,000 16 2. The moneys appropriated in subsection 1 shall be used for 17 the public purpose of providing a grant to a national nonprofit 18 organization with over 80 years of experience in assisting 19 children and adults with disabilities and special needs. The 20 moneys shall be used to support a nationally recognized program 21 that began in 1986 and has been replicated in at least 30 other 22 states, but which is not available through any other entity 23 in this state, and that provides assistance to farmers with 24 disabilities in all 99 counties to allow the farmers to remain 25 in their own homes and be gainfully engaged in farming through 26 provision of agricultural worksite and home modification 27 consultations, peer support services, services to families, 28 information and referral, and equipment loan services. 29 3. Notwithstanding section 8.33 , moneys appropriated in 30 this section that remain unencumbered or unobligated at the 31 close of the fiscal year shall not revert but shall remain 32 available for expenditure for the purposes designated until the 33 close of the succeeding fiscal year. 34 DIVISION II 35 -4- LSB 2649SV (3) 86 da/rn 4/ 43
S.F. 494 GENERAL FUND 1 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 2 WATER QUALITY INITIATIVE 3 APPROPRIATIONS FOR FY 2015-2016 4 Sec. 8. WATER QUALITY INITIATIVE —— GENERAL. 5 1. There is appropriated from the general fund of the state 6 to the department of agriculture and land stewardship for the 7 fiscal year beginning July 1, 2015, and ending June 30, 2016, 8 the following amount, or so much thereof as is necessary, to be 9 used for the purposes designated: 10 For deposit in the water quality initiative fund created in 11 section 466B.45 , for purposes of supporting the water quality 12 initiative administered by the soil conservation division as 13 provided in section 466B.42 , including salaries, support, 14 maintenance, and miscellaneous purposes, and for not more than 15 the following full-time equivalent positions: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,400,000 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . The moneys appropriated in subsection 1 shall be 19 used to support projects in subwatersheds as designated by the 20 division that are part of high-priority watersheds identified 21 by the water resources coordinating council established 22 pursuant to section 466B.3 . 23 b. The moneys appropriated in subsection 1 shall be used to 24 support projects in watersheds generally, including regional 25 watersheds, as designated by the division and high-priority 26 watersheds identified by the water resources coordinating 27 council established pursuant to section 466B.3. 28 3. In supporting projects in subwatersheds and watersheds 29 as provided in subsection 2, all of the following shall apply: 30 a. The demonstration projects shall utilize water quality 31 practices as described in the latest revision of the document 32 entitled “Iowa Nutrient Reduction Strategy” initially presented 33 in November 2012 by the department of agriculture and land 34 stewardship, the department of natural resources, and Iowa 35 -5- LSB 2649SV (3) 86 da/rn 5/ 43
S.F. 494 state university of science and technology. 1 b. The division shall implement demonstration projects as 2 provided in paragraph “a” by providing for participation by 3 persons who hold a legal interest in agricultural land used in 4 farming. To every extent practical, the division shall provide 5 for collaborative participation by such persons who hold a 6 legal interest in agricultural land located within the same 7 subwatershed. 8 c. The division shall implement a demonstration project on 9 a cost-share basis as determined by the division. However, the 10 state’s share of the amount shall not exceed 50 percent of the 11 estimated cost of establishing the practice as determined by 12 the division or 50 percent of the actual cost of establishing 13 the practice, whichever is less. 14 d. The demonstration projects shall be used to educate other 15 persons about the feasibility and value of establishing similar 16 water quality practices. The division shall promote field day 17 events for purposes of allowing interested persons to establish 18 water quality practices on their agricultural land. 19 e. The division shall conduct water quality evaluations 20 within supported subwatersheds. Within a reasonable period 21 after accumulating information from such evaluations, the 22 division shall create an aggregated database of water quality 23 practices. Any information identifying a person holding a 24 legal interest in agricultural land or specific agricultural 25 land shall be a confidential record under section 22.7 . 26 4. The moneys appropriated in subsection 1 shall be used 27 to support education and outreach in a manner that encourages 28 persons who hold a legal interest in agricultural land used for 29 farming to implement water quality practices, including the 30 establishment of such practices in watersheds generally, and 31 not limited to subwatersheds or high-priority watersheds. 32 5. The moneys appropriated in subsection 1 may be used 33 to contract with persons to coordinate the implementation of 34 efforts provided in this section. 35 -6- LSB 2649SV (3) 86 da/rn 6/ 43

The moneys appropriated in subsection 1 may be used by 1 the department to support urban soil and water conservation 2 efforts, which may include but are not limited to management 3 practices related to bioretention, landscaping, the use of 4 permeable or pervious pavement, and soil quality restoration. 5 The moneys shall be allocated on a cost-share basis as provided 6 in chapter 161A. 7 7. Notwithstanding any other provision of law to the 8 contrary, the department may use moneys appropriated in 9 subsection 1 to carry out the provisions of this section on a 10 cost-share basis in combination with other moneys available to 11 the department from a state or federal source. 12 8. Not more than 10 percent of the moneys appropriated in 13 this section may be used to pay for the costs of administering 14 and implementing the water quality initiative by the 15 department’s soil conservation division as provided in section 16 466B.42 and this section. 17 DIVISION III 18 DEPARTMENT OF NATURAL RESOURCES 19 GENERAL APPROPRIATIONS FOR FY 2015-2016 20 Sec. 9. GENERAL FUND —— DEPARTMENT. 21 1. There is appropriated from the general fund of the state 22 to the department of natural resources for the fiscal year 23 beginning July 1, 2015, and ending June 30, 2016, the following 24 amount, or so much thereof as is necessary, to be used for the 25 purposes designated: 26 For purposes of supporting the department, including its 27 divisions, for administration, regulation, and programs; for 28 salaries, support, maintenance, and miscellaneous purposes; and 29 for not more than the following full-time equivalent positions: 30 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,862,307 31 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . S.F. 494 department for seasonal employees for purposes of providing 1 maintenance, upkeep, and sanitary services at state parks. 2 This subsection shall not impact park ranger positions within 3 the department. 4 3. The department shall submit a report each quarter of the 5 fiscal year to the legislative services agency, the department 6 of management, the members of the joint appropriations 7 subcommittee on agriculture and natural resources, and the 8 chairpersons and ranking members of the senate and house 9 committees on appropriations. STATE FISH AND GAME PROTECTION FUND —— REGULATION 14 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 15 1. There is appropriated from the state fish and game 16 protection fund to the department of natural resources for the 17 fiscal year beginning July 1, 2015, and ending June 30, 2016, 18 the following amount, or so much thereof as is necessary, to be 19 used for the purposes designated: 20 For purposes of supporting the regulation or advancement of 21 hunting, fishing, or trapping, or the protection, propagation, 22 restoration, management, or harvest of fish or wildlife, 23 including for administration, regulation, law enforcement, and 24 programs; and for salaries, support, maintenance, equipment, 25 and miscellaneous purposes: 26 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 41,223,225 27 2. Notwithstanding section 455A.10 , the department may use 28 the unappropriated balance remaining in the state fish and game 29 protection fund to provide for the funding of health and life 30 insurance premium payments from unused sick leave balances of 31 conservation peace officers employed in a protection occupation 32 who retire, pursuant to section 97B.49B . 33 3. Notwithstanding section 455A.10 , the department of 34 natural resources may use the unappropriated balance remaining 35 -8- LSB 2649SV (3) 86 da/rn 8/ 43
S.F. 494 in the state fish and game protection fund for the fiscal 1 year beginning July 1, 2015, and ending June 30, 2016, as is 2 necessary to fund salary adjustments for departmental employees 3 for which the general assembly has made an operating budget 4 appropriation in subsection 1. 5 Sec. 11. GROUNDWATER PROTECTION FUND —— WATER 6 QUALITY. FORESTRY HEALTH MANAGEMENT. 27 1. VETERINARY DIAGNOSTIC LABORATORY. 11 1. There is appropriated from the general fund of the state 12 to Iowa state university of science and technology for the 13 fiscal year beginning July 1, 2015, and ending June 30, 2016, 14 the following amount, or so much thereof as is necessary, to be 15 used for the purposes designated: 16 For purposes of supporting the college of veterinary 17 medicine for the operation of the veterinary diagnostic 18 laboratory and for not more than the following full-time 19 equivalent positions: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,000,000 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . Iowa state university of science and technology 23 shall not reduce the amount that it allocates to support the 24 college of veterinary medicine from any other source due to the 25 appropriation made in this section. 26 b. Paragraph “a” does not apply to a reduction made to 27 support the college of veterinary medicine, if the same 28 percentage of reduction imposed on the college of veterinary 29 medicine is also imposed on all of Iowa state university of 30 science and technology’s budget units. 31 3. If by June 30, 2016, Iowa state university of science and 32 technology fails to allocate the moneys appropriated in this 33 section to the college of veterinary medicine in accordance 34 with this section, the moneys appropriated in this section for 35 -11- LSB 2649SV (3) 86 da/rn 11/ 43
S.F. 494 that fiscal year shall revert to the general fund of the state. 1 WATER QUALITY INITIATIVE 2 Sec. 17. IOWA NUTRIENT RESEARCH CENTER. 3 1. There is appropriated from the general fund of the state 4 to Iowa state university of science and technology for the 5 fiscal year beginning July 1, 2015, and ending June 30, 2016, 6 the following amount, or so much thereof as is necessary, to be 7 used for the purposes designated: 8 For purposes of supporting an Iowa nutrient research center 9 as established in section 466B.47 : 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,325,000 11 2. DATA COLLECTION OF IN-FIELD AGRICULTURAL PRACTICES 17 —— THREE-YEAR PILOT PROJECT. 18 1. Notwithstanding section 455E.11, subsection 2, 19 paragraph b, subparagraph (3), subparagraph division (b), 20 of the unobligated and unencumbered moneys remaining in the 21 agriculture management account of the groundwater protection 22 fund that would otherwise be required to be transferred to 23 the Iowa department of public health under that subparagraph 24 division, there is appropriated to Iowa state university of 25 science and technology for the fiscal year beginning July 1, 26 2015, and ending June 30, 2016, the following amount, or so 27 much thereof as is necessary, to be used for the purposes 28 designated: 29 a. For use by the university’s college of agriculture and 30 life sciences for purposes of supporting a three-year data 31 collection of in-field practices project: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,230,000 33 b. The three-year project shall be used to do all of the 4 following: 5 a. Enhance this state’s ability to track its progress in 6 reducing the transport of nutrients to water from nonpoint 7 sources within watersheds in accordance with the latest 8 revision of the document entitled “Iowa Nutrient Reduction 9 Strategy” initially presented in November 2012 by the 10 department of agriculture and land stewardship, the department 11 of natural resources, and Iowa state university of science and 12 technology. 13 b. Develop a database of in-field agricultural practices 14 and analyze the impact of those practices in the aggregate. 15 An agricultural practice includes but is not limited to soil 16 and water conservation practices, structures, technologies, 17 and agricultural inputs and outputs. The college may also 18 provide for the measurement of other impacts associated with 19 agricultural production. The finding of the pilot project 20 shall be used to develop a system to be implemented within a 21 broader range of watersheds that measures existing agricultural 22 practices and the impact of different nutrient management 23 decisions. 24 3. The college shall enter into a private-public 25 partnership with one or more persons responsible for receiving, 26 collecting, or holding data described in subsection 2. The 27 college shall provide for the terms and conditions of any legal 28 or financial arrangement that it enters into with such person. 29 Any information received, collected, or held by the person 30 shall be confidential in the same manner as provided in section 31 466B.49, subsection 2. The college shall only enter into an 32 arrangement with a person if the college is satisfied that the 33 person will protect the confidentiality of the information. 34 Any information including aggregate data transmitted to the 35 -13- LSB 2649SV (3) 86 da/rn 13/ 43
S.F. 494 college by the person shall be available for public examination 1 and copying under chapter 22, except for the same type of 2 information described in section 466B.49, subsection 2, which 3 shall remain confidential. 4 4. The college shall submit interim reports to the general 5 assembly by March 1, 2016, and March 1, 2017, and a final 6 report to the general assembly by March 1, 2018. The final 7 report shall include its findings and recommendations. 8 DIVISION V 9 ENVIRONMENT FIRST FUND 10 GENERAL APPROPRIATIONS FOR FY 2015-2016 11 Sec. 19. The 7 moneys shall be used to support a nationally recognized program 8 that began in 1986 and has been replicated in at least 30 other 9 states, but which is not available through any other entity 10 in this state, and that provides assistance to farmers with 11 disabilities in all 99 counties to allow the farmers to remain 12 in their own homes and be gainfully engaged in farming through 13 provision of agricultural worksite and home modification 14 consultations, peer support services, services to families, 15 information and referral, and equipment loan services. 16 3. Notwithstanding section 8.33 , moneys appropriated in 17 this section that remain unencumbered or unobligated at the 18 close of the fiscal year shall not revert but shall remain 19 available for expenditure for the purposes designated until the 20 close of the succeeding fiscal year. 21 DIVISION IX 22 GENERAL FUND 23 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 24 WATER QUALITY INITIATIVE 25 APPROPRIATIONS FOR FY 2016-2017 26 Sec. 31. In supporting projects in subwatersheds and watersheds 16 as provided in subsection 2, all of the following shall apply: 17 a. The demonstration projects shall utilize water quality 18 practices as described in the latest revision of the document 19 entitled “Iowa Nutrient Reduction Strategy” initially presented 20 in November 2012 by the department of agriculture and land 21 stewardship, the department of natural resources, and Iowa 22 state university of science and technology. 23 b. The division shall implement demonstration projects as 24 provided in paragraph “a” by providing for participation by 25 persons who hold a legal interest in agricultural land used in 26 farming. To every extent practical, the division shall provide 27 for collaborative participation by such persons who hold a 28 legal interest in agricultural land located within the same 29 subwatershed. 30 c. The division shall implement a demonstration project on 31 a cost-share basis as determined by the division. However, the 32 state’s share of the amount shall not exceed 50 percent of the 33 estimated cost of establishing the practice as determined by 34 the division or 50 percent of the actual cost of establishing 35 -25- LSB 2649SV (3) 86 da/rn 25/ 43
S.F. 494 the practice, whichever is less. 1 d. The demonstration projects shall be used to educate other 2 persons about the feasibility and value of establishing similar 3 water quality practices. The division shall promote field day 4 events for purposes of allowing interested persons to establish 5 water quality practices on their agricultural land. 6 e. The division shall conduct water quality evaluations 7 within supported subwatersheds. Within a reasonable period 8 after accumulating information from such evaluations, the 9 division shall create an aggregated database of water quality 10 practices. Any information identifying a person holding a 11 legal interest in agricultural land or specific agricultural 12 land shall be a confidential record under section 22.7 . 13 4. The moneys appropriated in subsection 1 shall be used 14 to support education and outreach in a manner that encourages 15 persons who hold a legal interest in agricultural land used for 16 farming to implement water quality practices, including the 17 establishment of such practices in watersheds generally, and 18 not limited to subwatersheds or high-priority watersheds. 19 5. The moneys appropriated in subsection 1 may be used 20 to contract with persons to coordinate the implementation of 21 efforts provided in this section. 22 6. The moneys appropriated in subsection 1 may be used by 23 the department to support urban soil and water conservation 24 efforts, which may include but are not limited to management 25 practices related to bioretention, landscaping, the use of 26 permeable or pervious pavement, and soil quality restoration. 27 The moneys shall be allocated on a cost-share basis as provided 28 in chapter 161A. 29 7. Notwithstanding any other provision of law to the 30 contrary, the department may use moneys appropriated in 31 subsection 1 to carry out the provisions of this section on a 32 cost-share basis in combination with other moneys available to 33 the department from a state or federal source. 34 8. PERSONNEL SETTLEMENT AGREEMENT PAYMENTS. Section 161A.80, subsection 2, paragraphs a and b, 5 Code 2015, are amended by striking the paragraphs. 6 Sec. 46. Section 161A.80, Code 2015, is amended by adding 7 the following new subsection: 8 NEW SUBSECTION . 3. This section is repealed on July 1, 9 2025. 10 Sec. 47. NEW SECTION . 161A.80A Outstanding bluffland 11 protection loans. 12 1. The principal and interest from any blufflands 13 protection loan made pursuant to section 161A.80 remaining 14 outstanding on July 1, 2025, that would have been payable to 15 the blufflands protection revolving fund created in section 16 161A.80, shall instead be paid to the division on or after July 17 1, 2015, pursuant to the terms of the loan agreement. The 18 moneys paid to the division shall be credited to the rebuild 19 Iowa infrastructure fund created in section 8.57. 20 2. This section is repealed on July 1, 2030. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 GENERAL. This bill relates to agriculture and natural 25 resources by making appropriations for the fiscal years 26 2015-2016 and 2016-2017 to support related entities, including 27 the department of agriculture and land stewardship (DALS), 28 the department of natural resources (DNR), and Iowa state 29 university (ISU). 30 The bill primarily appropriates moneys to DALS and DNR. 31 The appropriations are made to support those departments for 32 administration, regulation, and support of programs. The bill 33 requires the departments to submit quarterly reports to the 34 general assembly and department of management regarding the 35 -38- LSB 2649SV (3) 86 da/rn 38/ 43
S.F. 494 expenditure of appropriated moneys. The bill also provides 1 moneys to support specific programs or projects administered by 2 those departments. The bill appropriates moneys from a number 3 of sources, including the general fund of the state, the state 4 fish and game protection fund, the groundwater protection fund 5 (Code section 455E.11), and the environment first fund (Code 6 section 8.57A). The bill is organized into divisions. 7 DALS —— GENERAL FUND APPROPRIATIONS —— FY 2015-2016. For 8 DALS, moneys are appropriated from the general fund of the 9 state for FY 2015-2016 in order to support its administrative 10 divisions, including consumer protection and industry services, 11 soil conservation, and food safety and animal health. Moneys 12 are transferred to ISU to support its midwest grape and wine 13 institute. 14 DALS —— MISCELLANEOUS FUNDS APPROPRIATIONS —— FY 2015-2016. 15 The bill appropriates moneys from a number of sources for 16 FY 2015-2016 to support DALS in order to support designated 17 purposes, including moneys derived from unclaimed winnings from 18 horse and dog races, for administration and enforcement of 19 racing regulations (Code section 99D.22); and moneys credited 20 to the renewable fuel infrastructure fund (Code section 21 159A.16), for purposes of motor fuel inspection and auditing 22 biofuel processing and production (Code chapter 214A). 23 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2015-2016. 24 The bill also makes special appropriations from the general 25 fund of the state for FY 2015-2016 to DALS in order to support 26 specific purposes including milk inspection (Code section 27 192.109), the local food and farm program (Code chapter 267A), 28 an agricultural education organization, and assistance to 29 farmers with disabilities. 30 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY 31 INITIATIVE —— FY 2015-2016. The bill makes appropriations from a number 3 of funds for FY 2015-2016 to DNR in order to support its 4 administrative divisions involving natural resources and 5 environmental protection from the general fund of the state, 6 the state fish and game protection fund, and the groundwater 7 protection fund. 8 DNR —— DESIGNATED MISCELLANEOUS FUNDS APPROPRIATIONS —— FY 9 2015-2016. The bill appropriates moneys for FY 2015-2016 to 10 DNR from a number of sources to support designated purposes, 11 including moneys deposited in the special snowmobile fund 12 (Code section 321G.7) to provide for administering and 13 enforcing the state snowmobile programs; and moneys deposited 14 in the unassigned revenue fund for purposes of paying for 15 administration of the department’s underground storage tanks 16 section. 17 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2015-2016. 18 The bill also makes special appropriations from the general 19 fund of the state for FY 2015-2016 to DNR in order to support 20 specific purposes including floodplain management and dam 21 safety and forestry health management programs. 22 ISU —— SPECIAL GENERAL FUND AND GROUNDWATER PROTECTION 23 FUND APPROPRIATIONS —— FY 2015-2016. The bill appropriates 24 moneys from the general fund of the state for FY 2015-2016 25 to ISU to support the operation of its veterinary diagnostic 26 laboratory. The bill appropriates moneys to ISU to support the 27 Iowa nutrient research center (Code section 466B.47). The bill 28 appropriates moneys from the agriculture management account of 29 the groundwater protection fund to the college of agriculture 30 and life sciences for purposes of supporting a three-year data 31 collection of in-field agricultural practices pilot project. 32 DALS AND DNR —— ENVIRONMENT FIRST FUND (EFF) APPROPRIATIONS 33 —— FY 2015-2016.
