S.F. 398 Section 1. Section 91A.9, subsection 3, Code 2015, is 1 amended to read as follows: 2 3. The commissioner may employ such qualified personnel 3 as are necessary for the enforcement of this chapter . Such 4 personnel shall be employed pursuant to chapter 8A, subchapter 5 IV . The commissioner shall employ investigators for the 6 enforcement of this chapter. 7 Sec. 2. Section 91A.9, Code 2015, is amended by adding the 8 following new subsection: 9 NEW SUBSECTION . 4A. The commissioner shall establish a 10 statewide, toll-free telephone hotline for the purpose of 11 receiving reports of violations of this chapter. 12 Sec. 3. NEW SECTION . 91A.15 Wage theft compliance 13 assistance coordinator. 14 The commissioner shall employ a wage theft compliance 15 assistance coordinator for the purposes of coordinating 16 enforcement and other actions by the commissioner relating to 17 this chapter and engaging in public relations and outreach 18 efforts to promote compliance with and enforcement of this 19 chapter. 20 Sec. 4. NEW SECTION . 91A.16 Standing appropriation. 21 There is appropriated annually from the general fund 22 of the state to the division of labor services one hundred 23 seventy-five thousand dollars, or so much thereof as is 24 necessary, for the enforcement of the wage theft provisions of 25 this chapter. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to wage payment collection by employees of 30 the labor commissioner. 31 The bill requires the labor commissioner to employ 32 investigators for the enforcement of Code chapter 91A, 33 Iowa wage payment collection law. The bill requires the 34 commissioner to establish a statewide, toll-free telephone 35 -1- LSB 1920XS (5) 86 je/rj 1/ 2
S.F. 398 hotline for the purpose of receiving reports of violations 1 of Code chapter 91A. The bill requires the commissioner to 2 employ a wage theft compliance assistance coordinator for the 3 purposes of coordinating enforcement and other actions by the 4 commissioner relating to Code chapter 91A and engaging in 5 public relations and outreach efforts to promote compliance 6 with and enforcement of Code chapter 91A. 7 The bill creates standing appropriation from the general 8 fund of the state to the division of labor services of $175,000 9 for enforcement of the wage theft provisions of Code chapter 10 91A. 11 -2- LSB 1920XS (5) 86 je/rj 2/ 2
