S.F. 374 Section 1. Section 296.3, Code 2015, is amended to read as 1 follows: 2 296.3 Election called. 3 1. Within ten days of receipt of a petition filed under 4 section 296.2 , the president of the board of directors shall 5 call a meeting of the board. The meeting shall be held within 6 thirty days after the petition was received. At the meeting, 7 the board shall call the election, fixing the time of the 8 election, which may , subject to the limitation in subsection 2, 9 be at the time and place of holding the regular school election 10 on a date specified in section 39.2, subsection 4, paragraph 11 “c” . However, if the board determines by unanimous vote that 12 the proposition or propositions requested by a petition to be 13 submitted at an election are grossly unrealistic or contrary 14 to the needs of the school district, no election shall be 15 called. If more than one petition has been received by the 16 time the board meets to consider the petition triggering the 17 meeting, the board shall act upon the petitions in the order 18 they were received at the meeting called to consider the 19 initial petition. The decision of the board may be appealed to 20 the state board of education as provided in chapter 290 . The 21 president shall notify the county commissioner of elections of 22 the time of the election. 23 2. The date of an election fixed by the board of directors 24 under subsection 1 shall be a date that is not less than one 25 year after the date of the last election held on a proposition 26 under this chapter. 27 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 28 immediate importance, takes effect upon enactment. 29 Sec. 3. APPLICABILITY. S.F. 374 This bill relates to school district elections to authorize 1 the issuance of indebtedness and general obligation bonds under 2 Code chapter 296. 3 Code chapter 296 authorizes the issuance of such 4 indebtedness and bonds to defray the cost of purchasing, 5 building, furnishing, reconstructing, repairing, improving or 6 remodeling a schoolhouse or schoolhouses and additions thereto, 7 gymnasium, stadium, field house, school bus garage, teachers’ 8 or superintendent’s home or homes, and procuring a site or 9 sites therefor, or purchasing land to add to a site already 10 owned, or procuring and improving a site for an athletic field, 11 or improving a site already owned for an athletic field, and 12 for any one or more of such purposes. 13 Current Code section 296.3 specifies the procedure and 14 requirements used by a school board in fixing the time for an 15 election after receiving a petition calling for an election on 16 the issuance of indebtedness or bonds in excess of 1.25 percent 17 of the assessed value of the taxable property in the school 18 district. The bill provides that the date of the election 19 may be held on a special election date specified in Code 20 section 39.2(4)(c). The bill also provides that the date of an 21 election fixed by the school board must be a date that is not 22 less than one year after the date of the last election held on a 23 proposition under Code chapter 296. 24 The bill takes effect upon enactment and applies to 25 propositions submitted to voters at an election held on or 26 after the effective date of the bill. 27 -2- LSB 2087XS (5) 86 md/sc 2/ 2
