S.F. 316 Section 1. Section 321I.14, subsection 2, Code 2015, is 1 amended to read as follows: 2 2. a. A Except as otherwise provided in paragraphs “b” and 3 “c” , a person shall not operate or ride an all-terrain vehicle 4 with a firearm in the person’s possession unless it is unloaded 5 and enclosed in a carrying case. 6 b. However, a A nonambulatory person may carry an uncased 7 and unloaded firearm while operating or riding an all-terrain 8 vehicle. 9 c. A person may operate or ride an all-terrain vehicle with 10 a loaded firearm, whether concealed or not, if the person has 11 in the person’s possession and displays to a peace officer on 12 demand a valid permit to carry weapons which has been issued 13 to the person, and the person’s conduct is within the limits 14 of that permit. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to carrying a firearm while operating or 19 riding an all-terrain vehicle. 20 The bill amends Code section 321.14(2) to allow a person to 21 operate or ride an all-terrain vehicle with a loaded firearm, 22 whether concealed or not, if the person has in the person’s 23 possession and displays to a peace officer on demand a valid 24 permit to carry weapons which has been issued to the person, 25 and the person’s conduct is within the limits of that permit. 26 Current law provides that a person shall not operate or 27 ride an all-terrain vehicle with a firearm in the person’s 28 possession unless it is unloaded and enclosed in a carrying 29 case. However, a nonambulatory person may carry an uncased 30 and unloaded firearm while operating or riding an all-terrain 31 vehicle. 32 A person who violates Code section 321I.14(2) commits a 33 simple misdemeanor punishable as a scheduled fine in the amount 34 of $100 pursuant to Code section 805.8B(2A)(b)(3). 35 -1- LSB 1007XS (5) 86 jm/nh 1/ 1
