S.F. 309 Section 1. Section 901.2, subsection 2, paragraph d, Code 1 2015, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (4) Performance of a validated risk 3 assessment that includes a risk categorization taken from a 4 model approved by the department of corrections. 5 Sec. 2. Section 901.3, Code 2015, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 3. The presentence investigation report 8 shall contain the results of a validated risk assessment that 9 includes a risk categorization taken from a model approved by 10 the department of corrections. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill relates to the compilation of a presentence 15 investigation report in a criminal proceeding. 16 The bill requires a presentence investigation report 17 to contain the results of a validated risk assessment 18 categorization taken from a model approved by the department 19 of corrections. 20 A presentence investigation report details the background of 21 a defendant and is reviewed by the court prior to sentencing. 22 -1- LSB 2336SV (2) 86 jm/rj 1/ 1
