S.F. 307 Section 1. Section 29C.20B, Code 2015, is amended by 1 striking the section and inserting in lieu thereof the 2 following: 3 29C.20B Disaster case management grant fund and program. 4 1. a. A disaster case management grant fund is created 5 in the state treasury for the use of the executive council. 6 Moneys in the fund shall be expended if grants are awarded 7 pursuant to section 29C.20A following the governor’s 8 proclamation of a state of disaster emergency or the 9 declaration of a major disaster by the president of the United 10 States. 11 b. The executive council may make financial grants to meet 12 disaster-related case management needs of disaster-affected 13 individuals. The aggregate total of grants awarded shall 14 not be more than one million dollars during a fiscal year. 15 However, within the same fiscal year, additional funds may 16 be specifically authorized by the executive council to meet 17 additional needs. Of the one million dollar aggregate total, 18 fifty thousand dollars may be expended for contract entity 19 staff support, and fifty thousand dollars may be expended for 20 case management training and continuing training. 21 c. The department of human services shall work with the 22 department of homeland security and emergency management 23 and, as selected by the department of human services, a 24 representative of nonprofit, voluntary, and faith-based 25 organizations active in disaster recovery and response to 26 establish a statewide system of disaster case management 27 to be activated following the governor’s proclamation of a 28 disaster emergency or the declaration of a major disaster by 29 the president of the United States for individual assistance 30 purposes. 31 2. The department of human services shall administer 32 disaster case management grants. The department of human 33 services, in conjunction with the department of homeland 34 security and emergency management, shall establish a disaster 35 -1- LSB 2329XS (5) 86 tm/rj 1/ 5
S.F. 307 case management program and adopt rules pursuant to chapter 17A 1 necessary to administer the program. The executive council 2 shall use grant moneys to reimburse the department of human 3 services for actual expenses associated with the administration 4 of the grants. Under the program, the department of human 5 services shall coordinate case management services locally 6 through one or more contracted entities. The department of 7 human services shall implement an ongoing contract with a 8 provider of a statewide program with local offices throughout 9 the state to serve as the local administrative entity for the 10 grant program to allow implementation of the program with 11 minimal delay if grants are awarded pursuant to section 29C.20A 12 following a governor’s proclamation of a state of disaster 13 emergency or a declaration of a major disaster by the president 14 of the United States. 15 3. The department of human services, in conjunction with the 16 department of homeland security and emergency management and a 17 representative of the Iowa voluntary organizations active in 18 disaster, shall adopt rules pursuant to chapter 17A to create 19 coordination mechanisms and standards for the establishment 20 and implementation of a statewide system of disaster case 21 management. The rules adopted by the department of human 22 services for the program shall include but are not limited to 23 all of the following: 24 a. If a local administrative entity is under contract with 25 the state to provide other services or is implementing a state 26 or federal program and the contract contains a sufficient 27 surety bond or other adequate financial responsibility 28 provisions, the department shall accept the existing surety 29 bond or financial responsibility provisions in lieu of applying 30 a new or additional surety bond or financial responsibility 31 requirement. 32 b. Authorization for the local administrative entity to draw 33 down grant funding to pay valid claims on at least a weekly 34 basis. 35 -2- LSB 2329XS (5) 86 tm/rj 2/ 5

Coordination mechanisms necessary to carry out the 5 services provided. 6 h. Development of formal working relationships with agencies 7 and creation of interagency agreements for those considered to 8 provide disaster case management services. 9 i. Establishment of nonduplication of benefits policies and 10 mechanisms for the exchange of information between agencies to 11 ensure compliance with the federal Health Insurance Portability 12 and Accountability Act of 1996, Pub. L. No. 104-191, 110 Stat. 13 1936 (1996). 14 j. Referral to all known available services for individuals 15 from multiple agencies in coordinated service locations. 16 4. By January 1 of each year, the department of human 17 services shall submit an annual written report to the 18 legislative fiscal committee and the general assembly’s 19 standing committees on government oversight concerning the 20 activities of the grant program during the previous fiscal 21 year. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill creates a disaster case management grant fund and 26 program. 27 The bill replaces provisions relating to disaster case 28 management with a disaster case management fund. Moneys in 29 the fund must be expended if individual assistance grants 30 are awarded following the governor’s proclamation of a 31 state of disaster emergency or the declaration of a major 32 disaster by the president of the United States. The bill 33 allows the executive council to make financial grants to meet 34 disaster-related case management needs of disaster-affected 35 -3- LSB 2329XS (5) 86 tm/rj 3/ 5
