Section 135.61, subsection 18, paragraph m, 1 subparagraph (4), Code 2015, is amended to read as follows: 2 (4) Radiation therapy service applying ionizing radiation 3 for the treatment of malignant disease using megavoltage 4 external beam equipment with a value in excess of five million 5 dollars . 6 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 7 immediate importance, takes effect upon enactment. 8 Sec. 3. RETROACTIVE APPLICABILITY. This Act applies 9 retroactively to July 1, 2014. 10 Sec. 4. APPLICABILITY. This Act applies to certificate 11 of need applications submitted on or after July 1, 2014, for 12 radiation therapy service applying ionizing radiation for the 13 treatment of malignant disease using megavoltage external beam 14 equipment, and a party who is an affected person with respect 15 to the application may seek a rehearing on the application 16 pursuant to section 135.70. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 Currently, a certificate of need is required for all 21 radiation therapy service applying ionizing radiation for the 22 treatment of malignant disease using megavoltage external beam 23 equipment. Under the bill, a certificate of need would only 24 be required for such radiation therapy service with a value in 25 excess of $5 million. The bill takes effect upon enactment, 26 is retroactively applicable to July 1, 2014, and is applicable 27 to certificate of need applications for radiation therapy 28 services submitted on or after July 1, 2014, and a party who is 29 an affected person with respect to the application may seek a 30 rehearing on the application. 31 -1- LSB 2428XS (3) 86 pf/nh 1/ 1
