1.
Section
598.5,
subsection
1,
Code
2015,
is

amended
by
adding
the
following
new
paragraph:

whether
the
respondent
has
been

convicted
of
a
crime
against
the
petitioner
and
is
incarcerated

for
such
crime
at
the
time
of
the
filing
of
the
petition.

In
a
dissolution
of
marriage
action
under
this
chapter,

if
a
petitioner
includes
a
statement
as
specified
in
section
9
598.5,
subsection
1,
paragraph
“l”
,
in
the
petition,
verifies
10
the
petition,
and
establishes
the
allegations
of
the
petition
11
by
competent
evidence,
the
petitioner
shall
not
be
subject
to
12
payment
of
respondent’s
attorney
fees.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
if
a
petition
for
dissolution
of
17
marriage
includes
a
statement
that
the
respondent
has
been
18
convicted
of
a
crime
against
the
petitioner
and
is
incarcerated
19
for
such
crime
at
the
time
of
the
filing
of
the
petition,
20
the
petitioner
is
not
subject
to
payment
of
the
respondent’s
21
attorney
fees.
