Section
437A.5,
subsection
7,
Code
2015,
is

amended
by
adding
the
following
new
paragraph:

.

For
tax
years
beginning
on
or
after

January
1,
2015,
subsection
2
does
not
apply
to
natural
gas
4
consumed
by
a
person,
other
than
an
electric
company,
natural
5
gas
company,
electric
cooperative,
or
municipal
utility,
if
6
the
natural
gas
is
acquired
by
means
of
facilities
owned
by
or
7
leased
to
such
person
and
placed
into
service
after
January
1,
8
1999,
but
before
January
1,
2015,
that
were
physically
attached
9
to
pipelines
that
are
not
permitted
pursuant
to
chapter
479
10
and
used
by
such
person
for
the
purpose
of
bypassing
the
local
11
natural
gas
company
or
municipal
utility.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
13
immediate
importance,
takes
effect
upon
enactment.

Sec.
3.
RETROACTIVE
APPLICABILITY.
This
Act
applies
15
retroactively
to
January
1,
2015,
for
tax
years
beginning
on
16
or
after
that
date.

EXPLANATION
18
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
excludes
from
the
natural
gas
consumer
replacement
21
tax
under
Code
section
437A.5(2),
natural
gas
consumed
by
a
22
person,
other
than
an
electric
company,
natural
gas
company,
23
electric
cooperative,
or
municipal
utility,
if
the
natural
24
gas
is
acquired
by
means
of
facilities
owned
by
or
leased
to
25
such
person
and
placed
into
service
after
January
1,
1999,
26
but
before
January
1,
2015,
that
were
physically
attached
to
27
pipelines
that
are
not
permitted
pursuant
to
Code
chapter
28
479
and
used
by
such
person
for
the
purpose
of
bypassing
the

local
natural
gas
company
or
municipal
utility.
The
exclusion

provided
in
the
bill
is
for

bill
takes

enactment
and
