S.F. 243 Section 1. Section 331.304, subsection 3, paragraph b, Code 1 2015, is amended to read as follows: 2 b. A county building code shall not apply to farm houses 3 or other farm buildings which , except dwellings, that are 4 primarily adapted for use for agricultural purposes, while so 5 used or under construction for that use. 6 Sec. 2. Section 335.2, Code 2015, is amended to read as 7 follows: 8 335.2 Farms exempt. 9 Except to the extent required to implement section 335.27 , 10 no an ordinance adopted under this chapter applies shall not 11 apply to land, farm houses, farm barns, farm outbuildings or 12 other buildings or structures which , except dwellings, that are 13 primarily adapted, by reason of nature and area, for use for 14 agricultural purposes, while so used. However, the ordinances 15 may apply to any structure, building, dam, obstruction, 16 deposit , or excavation in or on the flood plains of any river 17 or stream. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 Current law provides for farm house exemptions from county 22 building codes and county zoning regulations. The bill removes 23 these exemptions for farm houses while maintaining similar 24 exemptions for other agricultural structures that are not 25 dwellings. 26 Pursuant to Code section 414.23, the changes in the bill to 27 the county zoning exemption for farm houses apply to a city 28 extending city zoning regulations to the unincorporated area 29 of a county up to two miles beyond the limits of such city, as 30 authorized by statute. 31 -1- LSB 2011XS (2) 86 aw/sc 1/ 1
