S.F. 2324 DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. DEPARTMENT OF ADMINISTRATIVE SERVICES 9 a. S.F. 2324 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,100,000 1 (2) (a) The moneys appropriated in this lettered 2 paragraph shall be used to support demonstration projects in 3 subwatersheds as designated by the department that are part 4 of high-priority watersheds identified by the water resources 5 coordinating council established pursuant to section 466B.3. 6 (b) The moneys appropriated in this lettered paragraph 7 shall be used to support demonstration projects in watersheds 8 generally, including regional watersheds, as designated by the 9 division and high-priority watersheds identified by the water 10 resources coordinating council established pursuant to section 11 466B.3. 12 (c) Of the moneys appropriated in this lettered paragraph, 13 $450,000 is allocated to the Iowa nutrient research center at 14 Iowa state university of science and technology for nutrient 15 water monitoring network technology and equipment. Of the 16 moneys allocated in this subparagraph division, not more than 17 $150,000 may be used for the operations and maintenance of the 18 nutrient water monitoring network. 19 (3) In supporting projects in watersheds and subwatersheds 20 as provided in subparagraph (2), subparagraph divisions (a) and 21 (b), all of the following shall apply: 22 (a) The demonstration projects shall utilize water quality 23 practices as described in the latest revision of the document 24 entitled “Iowa Nutrient Reduction Strategy” initially presented 25 in November 2012 by the department of agriculture and land 26 stewardship, the department of natural resources, and Iowa 27 state university of science and technology. 28 (b) The division shall implement demonstration projects 29 as provided in subparagraph division (a) by providing 30 for participation by persons who hold a legal interest in 31 agricultural land used in farming. To every extent practical, 32 the division shall provide for collaborative participation by 33 such persons who hold a legal interest in agricultural land 34 located within the same subwatershed. 35 -2- LSB 5018SV (2) 86 ec/tm 2/ 24
S.F. 2324 (c) The division shall implement demonstration projects on 1 a cost-share basis as determined by the division. However, the 2 state’s share of the amount shall not exceed 50 percent of the 3 estimated cost of establishing the practice as determined by 4 the division or 50 percent of the actual cost of establishing 5 the practice, whichever is less. 6 (d) The demonstration projects shall be used to educate 7 other persons about the feasibility and value of establishing 8 similar water quality practices. The division shall promote 9 field day events for purposes of allowing interested persons to 10 establish water quality practices on their agricultural land. 11 (e) The division shall conduct water quality evaluations 12 within supported subwatersheds. Within a reasonable period 13 after accumulating information from such evaluations, the 14 division shall create an aggregated database of water quality 15 practices. Any information identifying a person holding a 16 legal interest in agricultural land or specific agricultural 17 land shall be a confidential record. 18 (4) The moneys appropriated in this lettered paragraph 19 shall be used to support education and outreach in a manner 20 that encourages persons who hold a legal interest in 21 agricultural land used for farming to implement water quality 22 practices, including the establishment of such practices in 23 watersheds generally, and not limited to subwatersheds or 24 high-priority watersheds. 25 (5) The moneys appropriated in this lettered paragraph 26 may be used to contract with persons to coordinate the 27 implementation of efforts provided in this paragraph. 28 (6) The moneys appropriated in this lettered paragraph 29 may be used by the department to support urban soil and water 30 conservation efforts, which may include but are not limited 31 to management practices related to bioretention, landscaping, 32 the use of permeable or pervious pavement, and soil quality 33 restoration. S.F. 2324 (7) Notwithstanding any other provision of law to the 1 contrary, the department may use moneys appropriated in 2 this lettered paragraph to carry out the provisions of this 3 paragraph on a cost-share basis in combination with other 4 moneys available to the department from a state or federal 5 source. 6 (8) Not more than 10 percent of the moneys appropriated in 7 this lettered paragraph may be used for costs of administration 8 and implementation of the water quality initiative administered 9 by the soil conservation division. 10 b. S.F. 2324 SHALLOW LAKES 1 Sec. 15. Section 456A.33B, Code 2016, is amended by adding 2 the following new subsection: 3 NEW SUBSECTION . 01. For purposes of this section, unless 4 the context otherwise requires: 5 a. “Lake” includes a significant public lake and a public 6 shallow lake or wetland. 7 b. Public shallow lake or wetland” means a water body that 8 meets the following criteria: 9 (1) Is owned by the federal government, the state of 10 Iowa, a county, or a municipal government, and is maintained 11 principally for public use. 12 (2) Is a multi-use system capable of supporting diverse 13 wildlife, fish, or recreational opportunities. 14 (3) Has a surface water area of at least ten acres. 15 (4) Does not have a watershed-to-lake surface area ratio of 16 greater than two hundred to one. 17 (5) Is an open freshwater system where maximum depth is 18 typically less than six to eight feet at its deepest spot and 19 is under four and one-half feet mean depth. 20 (6) Is typically fringed by a border of emergent vegetation 21 in water depth less than six feet and when clear is dominated 22 by both emergent and submergent vegetation and provides 23 important wildlife and fish habitat. 24 c. “Significant public lake” means a lake that meets all of 25 the following criteria: 26 (1) Is owned by the federal government, the state of 27 Iowa, a county, or a municipal government, and is maintained 28 principally for public use. 29 (2) Is a multi-use system capable of supporting diverse 30 wildlife, fish, or recreational opportunities. 31 (3) Has a surface water area of at least ten acres. 32 (4) Does not have a watershed-to-lake surface area ratio of 33 greater than two hundred to one. 34 (5) Is not an on-stream impoundment that emulates riverine 35 -17- LSB 5018SV (2) 86 ec/tm 17/ 24
S.F. 2324 habitat rather than a lake environment. 1 (6) Is not used solely as a water supply reservoir. 2 Sec. 16. Section 456A.33B, subsection 1, paragraph b, Code 3 2016, is amended by adding the following new subparagraph: 4 NEW SUBPARAGRAPH . (6) When restored, will contribute to the 5 department’s fish and wildlife conservation plans. 6 Sec. 17. Section 456A.33B, subsection 2, paragraphs a and b, 7 Code 2016, are amended to read as follows: 8 a. The department , with input from stakeholders, shall 9 develop maintain an initial annual list of not more than 10 thirty-five significant public lakes and not more than five 11 public shallow lakes or wetlands to be considered for funding 12 based on the feasibility of restoring each lake and the use or 13 potential use of the lake, if restored. The list shall include 14 lake projects under active development that the department 15 shall recommend be given priority for funding so long as 16 progress toward completion of the projects remains consistent 17 with the goals of this section . 18 b. The department shall meet with stakeholders and 19 representatives of communities where lakes on the initial 20 annual list are located to provide an initial annual lake 21 restoration assessment and to explain the process and criteria 22 for receiving lake restoration funding. Communities with 23 lakes not included on the initial annual list may petition the 24 director of the department for a preliminary lake restoration 25 assessment and explanation of the funding process and criteria. 26 The department shall work with stakeholders and representatives 27 of each community to develop a joint lake restoration action 28 plan. At a minimum, each joint action plan shall document the 29 causes, sources, and magnitude of lake impairment, evaluate 30 the feasibility of the lake and watershed restoration options, 31 establish water quality and fishery and wildlife goals and a 32 schedule for attainment, describe long-term management actions, 33 assess the economic benefits of the project, identify the 34 sources and amounts of any leveraged funds, and describe the 35 -18- LSB 5018SV (2) 86 ec/tm 18/ 24
S.F. 2324 community’s commitment to the project, including local funding. 1 The stakeholders’ and community’s commitment to the project may 2 include moneys to fund a lake diagnostic study and watershed 3 assessment, including development of a TMDL (total maximum 4 daily load). 5 Sec. 18. Section 456A.33B, subsection 2, paragraph c, 6 subparagraph (2), Code 2016, is amended to read as follows: 7 (2) If proposed, dredging of the lake will be conducted to 8 a mean depth of at least ten eight feet to gain water quality 9 benefits unless a combination of biologic and structural 10 controls is sufficient to assure water quality targets will be 11 achieved at a shallower average water depth. 12 Sec. 19. Section 456A.33B, subsection 2, paragraph d, Code 13 2016, is amended to read as follows: 14 d. The department shall evaluate the joint action plans 15 and prioritize the plans based on the criteria required in 16 this section . The department’s annual lake restoration plan 17 and report shall include the prioritized list and the amounts 18 of state and other funding the department recommends for each 19 lake restoration project. The department may shall seek public 20 comment on its recommendations prior to submitting the plan and 21 report to the general assembly. 22 Sec. 20. Section 456A.33B, subsection 2, Code 2016, is 23 amended by adding the following new paragraph: 24 NEW PARAGRAPH . e. The department shall ensure that at least 25 eight percent, but no more than twelve percent, of the annual 26 appropriation for lake restoration projects in accordance with 27 the department’s annual lake restoration plan and report shall 28 be invested in public shallow lakes or wetlands restoration 29 projects. 30 DIVISION VI 31 MISCELLANEOUS PROVISIONS 32 Sec. 21. Section 8.57C, subsection 3, paragraph a, 33 subparagraph (2), Code 2016, is amended to read as follows: 34 (2) The fiscal year beginning July 1, 2016 2017 , and for 35 -19- LSB 5018SV (2) 86 ec/tm 19/ 24
S.F. 2324 each subsequent fiscal year thereafter. 1 Sec. 22. Section 12.79, subsection 3, Code 2016, is amended 2 to read as follows: 3 3. Moneys in the fund in a fiscal year shall be used as 4 appropriated by the general assembly for prison improvement and 5 prison construction projects. However, for the fiscal year 6 beginning July 1, 2016, any unobligated and unencumbered moneys 7 in the fund from the previous fiscal year are appropriated to 8 the department of corrections for major maintenance projects. 9 Sec. 23. IOWA COMMUNICATIONS NETWORK —— AUTHORIZATION 10 FOR CONTRACTS. Pursuant to section 8D.11, subsection 1, 11 paragraph “a”, the general assembly authorizes the Iowa 12 telecommunications and technology commission to enter into a 13 contract or contracts in excess of the contract limitation 14 amount established in section 8D.11, subsection 1, paragraph 15 “c”, for purposes of the commission’s network core upgrade 16 project. This authorization applies for the duration of the 17 commission’s project and to all existing or future contracts 18 associated with the project, whether or not the award is made 19 to a single vendor or multiple vendors. 20 Sec. 24. REBUILD IOWA INFRASTRUCTURE FUND —— LIMITATION ON 21 EXPENDITURES. 22 1. For purposes of this section, “restricted employee” 23 means an elective constitutional or statutory officer, a state 24 employee whose salary is set by the governor within a range set 25 by the general assembly, or a president of a state board of 26 regents institution. 27 2. Beginning July 1, 2016, moneys appropriated from the 28 rebuild Iowa infrastructure fund and used for public vertical 29 infrastructure projects as defined in section 8.57, subsection 30 5, paragraph “c”, shall not be used for salary or other 31 compensation costs of a restricted employee. 32 Sec. 25. REBUILD IOWA INFRASTRUCTURE FUND —— FY 2017-2018 33 BUDGET REQUEST INFORMATION. Finalized agency budget requests 34 submitted to the governor for the fiscal year beginning 35 -20- LSB 5018SV (2) 86 ec/tm 20/ 24
S.F. 2324 July 1, 2017, that include a request for an appropriation 1 from the rebuild Iowa infrastructure fund to be used for a 2 public vertical infrastructure project as defined in section 3 8.57, subsection 5, paragraph “c”, shall include salary cost 4 information as required by this section. The salary cost 5 information shall include the number of full-time equivalent 6 positions to be utilized for the requested project and that 7 portion, in dollars, of salaries and any compensation costs 8 attributable to these full-time equivalent positions that will 9 be paid from the requested appropriation from the rebuild Iowa 10 infrastructure fund. 11 Sec. 26. EXECUTIVE COUNCIL —— PROPERTY ACQUISITION 12 AUTHORIZATION. For the fiscal year beginning July 1, 2016, the 13 executive council may, in its sole discretion, expend moneys 14 as a performance of duty expense pursuant to section 7D.29 to 15 provide funding for the acquisition of property located at 525 16 East 9th street in the vicinity of the capitol complex. 17 Sec. 27. EFFECTIVE UPON ENACTMENT. The following provision 18 of this division of this Act, being deemed of immediate 19 importance, takes effect upon enactment: 20 1. The section of this division of this Act authorizing the 21 Iowa telecommunications and technology commission to enter into 22 a contract or contracts. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill relates to and makes appropriations to state 27 departments and agencies from the rebuild Iowa infrastructure 28 fund, the technology reinvestment fund, the state bond 29 repayment fund, and the FY 2009 prison bonding fund, and 30 provides for related matters. The bill is organized by 31 divisions. 32 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 33 division appropriates project funding for FY 2016-2017 from 34 the rebuild Iowa infrastructure fund for projects for the 35 -21- LSB 5018SV (2) 86 ec/tm 21/ 24
S.F. 2324 departments of administrative services, agriculture and land 1 stewardship, corrections, cultural affairs, human services, 2 natural resources, public defense, and transportation, and for 3 the economic development authority, treasurer of state, the 4 Iowa law enforcement academy, and the board of regents. The 5 division appropriates project funding for FY 2016-2017 and 6 FY 2017-2018 from the rebuild Iowa infrastructure fund for 7 projects for the department of cultural affairs and the state 8 fair authority. The division appropriates project funding for 9 FY 2016-2017, FY 2017-2018, and FY 2018-2019 from the rebuild 10 Iowa infrastructure fund for projects for the judicial branch. 11 DIVISION II —— REBUILD IOWA INFRASTRUCTURE FUND —— 12 TECHNOLOGY APPROPRIATIONS. This division appropriates project 13 funding for FY 2016-2017 from the rebuild Iowa infrastructure 14 fund for technology projects for the departments of education, 15 human rights, management, public defense, public health, 16 homeland security and emergency management, and public safety, 17 and for the Iowa telecommunications and technology commission 18 and secretary of state. The division appropriates project 19 funding for FY 2016-2017 and FY 2017-2018 from the rebuild Iowa 20 infrastructure fund for technology projects for the department 21 of cultural affairs. 22 DIVISION III —— MISCELLANEOUS APPROPRIATIONS. This division 23 appropriates project funding for FY 2016-2017 from the 24 technology reinvestment fund for the department of education. 25 This division also appropriates project funding for FY 26 2016-2017 from the state bond repayment fund for the department 27 of administrative services, the Iowa finance authority, the 28 board of regents, and the Iowa veterans home. 29 DIVISION IV —— CHANGES TO PRIOR APPROPRIATIONS. This 30 division provides for the reversion of certain unencumbered or 31 unobligated moneys from the technology reinvestment fund to the 32 department of education for FY 2012-2013. 33 The division also makes a change to moneys appropriated from 34 the rebuild Iowa infrastructure fund to the board of regents 35 -22- LSB 5018SV (2) 86 ec/tm 22/ 24
S.F. 2324 for a project at the state university of Iowa for FY 2016-2017 1 and FY 2017-2018. 2 This division also strikes funding from the rebuild Iowa 3 infrastructure fund for project funding to the board of regents 4 and the Iowa veterans home for FY 2016-2017. The bill provides 5 funding for these projects through the state bond repayment 6 fund. 7 The bill makes a change to the funding match requirements 8 for moneys appropriated from the rebuild Iowa infrastructure 9 fund for project funding to the department of human services 10 for FY 2015-2016. This provision applies retroactively to July 11 1, 2015. 12 This division takes effect upon enactment. 13 DIVISION V —— SHALLOW LAKES. This division amends Code 14 section 456A.33B concerning the requirement of the department 15 of natural resources to develop a lake restoration plan and 16 report. The division adds definitions to the Code section and 17 provides that “lake” includes both significant public lakes 18 and public shallow lakes or wetlands. The division further 19 defines “significant public lake” and “public shallow lake or 20 wetland”. The division adds the department’s fish and wildlife 21 conservation plans as a goal for lake restoration projects 22 and provides that the annual report include not more than 23 five public shallow lakes or wetlands to be considered for 24 funding. In addition, the bill provides for stakeholder input 25 in developing the annual plan and report and requires that the 26 department seek public comment prior to submitting the plan and 27 report to the general assembly. Finally, the division provides 28 that not less than 8 percent, nor more than 12 percent, of the 29 annual appropriation for lake restoration projects be invested 30 in public shallow lakes or wetlands restoration projects. 31 DIVISION VI —— MISCELLANEOUS PROVISIONS. Code section 32 8.57C, concerning the technology reinvestment fund, is amended 33 to provide that the appropriation to the fund from the general 34 fund for fiscal years beginning on or after July 1, 2016, is 35 -23- LSB 5018SV (2) 86 ec/tm 23/ 24
S.F. 2324 changed to fiscal years beginning on or after July 1, 2017. 1 Code section 12.79, concerning the FY 2009 prison bonding 2 fund, is amended to provide that for FY 2016-2017, any 3 unobligated and unencumbered moneys in the fund from the 4 previous fiscal year are appropriated to the department of 5 corrections for major maintenance projects. 6 The division also authorizes the Iowa telecommunications and 7 technology commission to enter into a contract or contracts 8 in excess of the statutory contract limitation amount for 9 purposes of the commission’s network core upgrade project. 10 This provision of this division of the bill takes effect upon 11 enactment. 12 The division further provides that beginning July 1, 2016, 13 moneys appropriated from the rebuild Iowa infrastructure fund 14 and used for vertical infrastructure projects shall not be 15 used for salary and other compensation costs of a restricted 16 employee.
