1.
NEW
SECTION
.
136D.3A
Use
of
tanning
devices
by
1
minors
prohibited.
2
1.
A
tanning
facility
shall
not
allow
a
person
under
3
eighteen
years
of
age
to
use
a
tanning
device.
4
2.
a.
This
section
shall
not
apply
in
circumstances
in
5
which
a
person
under
eighteen
years
of
age
possesses
a
written
6
order
from
a
health
care
professional
for
the
use
of
a
tanning
7
device
determined
to
be
medically
necessary
by
the
health
8
care
professional.
A
tanning
facility
shall
keep
a
record
of
9
all
written
orders
received
by
the
tanning
facility
pursuant
10
to
this
paragraph.
A
written
order
issued
pursuant
to
this
11
paragraph
shall
expire
one
year
after
the
date
of
issuance
and
12
may
be
renewed
annually.

b.
For
purposes
of
this
subsection,
“health
care
14
professional”
means
a
person
who
is
licensed,
certified,
or
15
otherwise
authorized
or
permitted
by
the
law
of
this
state
to
16
administer
health
care
in
the
ordinary
course
of
business
or
in
17
the
practice
of
a
profession.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
tanning
facilities
and
creates
new
Code
22
section
136D.3A
prohibiting
a
tanning
facility
from
allowing
23
a
person
under
18
years
of
age
to
use
a
tanning
device.
The
24
prohibition
does
not
apply
if
a
person
under
18
years
of
age
25
possesses
a
written
order
from
a
health
care
professional,
as
26
defined
in
the
bill,
for
the
use
of
a
tanning
device
determined
27
to
be
medically
necessary
by
the
health
care
provider.
A
28
tanning
facility
is
required
to
keep
a
record
of
all
written
29
orders
and
a
written
order
expires
one
year
after
the
date
of
30
issuance
and
may
be
renewed
annually.
31
A
person
who
violates
a
provision
of
Code
chapter
136D
is
32
subject
to
a
civil
penalty
and
an
injunction
restraining
any
33
violation.
