S.F. 2260 Section 1. DISCLOSURE OF OWNERSHIP OR CONTROL INFORMATION 1 BY NONPROFIT CORPORATIONS UNDER MEDICAID PROGRAM. Any 2 information required to be provided by a disclosing entity 3 pursuant to 42 C.F.R. §455.104, pertaining to an individual 4 with an ownership or control interest who is an officer or 5 director of a nonprofit corporation, shall only be required 6 to be disclosed to and collected by the department of human 7 services as the single state agency designated to administer 8 or supervise the administration of the Medicaid program. A 9 Medicaid managed care organization contracting with the state 10 shall not require disclosure or collection of such ownership 11 or control information from a nonprofit corporation and the 12 department of human services shall not redisseminate such 13 information disclosed to and collected by the department to any 14 such managed care organization. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill requires that any information required to be 19 provided under the Medicaid program by a disclosing entity 20 under federal law, pertaining to an individual with an 21 ownership or control interest who is an officer or director of 22 a nonprofit corporation, shall only be required to be disclosed 23 to and collected by the department of human services (DHS). 24 A managed care organization contracting with the state shall 25 not require disclosure or collection of such ownership and 26 control information from a nonprofit corporation and DHS shall 27 not redisseminate such information to any such managed care 28 organization. 29 -1- LSB 5608SV (2) 86 pf/nh 1/ 1
