S.F. 2206 Section 1. Section 233.1, subsection 2, paragraph a, Code 1 2016, is amended to read as follows: 2 a. “Institutional health facility” means any of the 3 following: 4 (1) a A hospital as defined in section 135B.1 , including 5 a facility providing medical or health services that is open 6 twenty-four hours per day, seven days per week and is a 7 hospital emergency room or a health care facility as defined 8 in section 135C.1 . 9 (2) An emergency medical care provider who provides 10 emergency medical services as defined in section 147A.1. 11 (3) A licensed emergency care facility, as defined in 12 section 147A.21, that is a freestanding facility. 13 (4) A licensed child-placing agency, as defined in section 14 238.1, that meets all of the following criteria: 15 (a) Agrees to act as a designated emergency infant care 16 provider. 17 (b) Employs a licensed registered nurse or another 18 individual who performs reasonable acts necessary to protect 19 the physical health or safety of the newborn infant. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to institutional health facilities 24 authorized under the newborn safe haven Act to accept the 25 voluntary relinquishment of physical custody of a newborn 26 infant by a parent of a newborn infant up to 14 days old, or by 27 a person authorized by the parent, without fear of prosecution 28 for abandonment. 29 Under current law, “institutional health facility” means 30 a hospital including a facility providing medical or health 31 services that is open 24 hours per day, seven days per week and 32 is a hospital emergency room or a health care facility. 33 The bill expands the definition of “institutional health 34 facility” to include an emergency medical care provider who 35 -1- LSB 5874XS (3) 86 rh/rj 1/ 2
