Section
802.2B,
Code
2016,
is
amended
by
adding
1
the
following
new
subsection:

Child
endangerment
in
violation
of

section
726.6.

EXPLANATION
5
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
6
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
limitations
on
criminal
actions
for
8
the
criminal
offense
of
child
endangerment.

Under
the
bill,
an
information
or
indictment
for
child
10
endangerment
in
violation
of
Code
section
726.6
committed
on
or
11
with
a
person
who
is
a
child
under
the
age
of
14
or
who
is
under
12
the
age
of
18
and
who
has
a
mental
or
physical
disability,
13
shall
be
found
within
10
years
after
the
person
upon
whom
the
14
offense
is
committed
attains
18
years
of
age.
15
Current
law
provides
that
an
indictment
or
information
16
shall
be
found
within
three
years
after
its
commission.
The
17
punishment
for
child
endangerment
ranges
from
a
class
“B”
18
felony
to
an
aggravated
misdemeanor
depending
on
the
facts
of
19
the
case.
20
The
bill
also
provides
that
if
the
person
against
whom
the
21
information
or
indictment
for
child
endangerment
is
sought
is
22
identified
through
the
use
of
a
DNA
profile,
an
information
23
or
indictment
shall
be
found
within
10
years
after
the
person
24
upon
whom
the
offense
was
committed
attains
18
years
of
age,
or
25
within
three
years
from
the
date
the
person
is
identified
by
26
the
person’s
DNA
profile,
whichever
is
later.
