S.F. 2133 Section 1. NEW SECTION . 481A.41 Baiting of deer allowed. 1 1. As used in this section, unless the context otherwise 2 requires: 3 a. “Baited area” means any area where feed is placed, 4 exposed, deposited, distributed, or scattered with the intent 5 to lure, attract, or entice deer to a specific location. An 6 area remains a “baited area” for ten days following complete 7 removal of all feed from the area. 8 b. “Feed” means grain, fruit, vegetables, nuts, hay, salt, 9 mineral blocks, or any other natural food materials; commercial 10 products containing natural food materials; or by-products of 11 such materials, that are capable of luring, attracting, or 12 enticing deer to a specific location. “Feed” does not include 13 food placed during normal agricultural activities. 14 2. Notwithstanding any provision to the contrary, a person 15 may hunt, take, or attempt to take deer on or in a baited area 16 on private property. 17 3. Notwithstanding any provision to the contrary, a person 18 may place, expose, deposit, distribute, or scatter feed on 19 a baited area on any private property under the person’s 20 ownership or lease, or may allow another person to place, 21 expose, deposit, distribute, or scatter feed on a baited area 22 on private property under the person’s ownership or lease in 23 the state. 24 Sec. 2. Section 805.8B, subsection 3, paragraph e, Code 25 2016, is amended to read as follows: 26 e. For violations of sections 481A.41, 481A.57 , 481A.85 , 27 481A.93 , 481A.95 , 481A.120 , 481A.137 , 481B.5 , 482.3 , 482.9 , 28 482.15 , and 483A.42 , the scheduled fine is one hundred dollars. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 This bill allows hunting, taking, or attempting to take 33 deer on or in a baited area on private property. S.F. 2133 property under the person’s control or allow another person to 1 do so. 2 For purposes of the bill, “feed” is grain, fruit, 3 vegetables, nuts, hay, salt, mineral blocks, or any other 4 natural food materials; commercial products containing natural 5 food materials; or by-products of such materials, that are 6 capable of luring, attracting, or enticing deer to a specific 7 location. “Feed” does not include food placed during normal 8 agricultural activities.
