S.F. 2126 Section 1. NEW SECTION . 249A.4C Prior statutory approval 1 —— implementation of Medicaid state plan amendment and waiver 2 requests. 3 Implementation of any medical assistance state plan 4 amendment or waiver submitted by the department to and approved 5 by the centers for Medicare and Medicaid services of the 6 United States department of health and human services, shall 7 be subject to prior authorization by a constitutional majority 8 of each house of the general assembly and approval by the 9 governor. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill requires prior authorization by a constitutional 14 majority of each house of the general assembly and approval by 15 the governor of the implementation of any medical assistance 16 state plan amendment or waiver submitted by the department to 17 and approved by the centers for Medicare and Medicaid services 18 of the United States department of health and human services. 19 -1- LSB 5535XS (3) 86 pf/rj 1/ 1
