S.F. 2124 Section 1. Section 280.23, Code 2016, is amended to read as 1 follows: 2 280.23 Student health services —— athletic trainers . 3 1. The board of directors of each public school district 4 and the authorities in charge of each nonpublic school shall 5 not require nonadministrative personnel to perform any special 6 health services or intrusive nonemergency medical services for 7 students unless the nonadministrative personnel are licensed or 8 otherwise qualified and have consented to perform the services. 9 2. The board of directors of each school district and the 10 authorities in charge of each nonpublic school shall have a 11 contractual relationship with at least one athletic trainer 12 licensed under chapter 152D. 13 Sec. 2. STATE MANDATE FUNDING SPECIFIED. In accordance 14 with section 25B.2, subsection 3, the state cost of requiring 15 compliance with any state mandate included in this Act shall 16 be paid by a school district from state school foundation aid 17 received by the school district under section 257.16. This 18 specification of the payment of the state cost shall be deemed 19 to meet all of the state funding-related requirements of 20 section 25B.2, subsection 3, and no additional state funding 21 shall be necessary for the full implementation of this Act 22 by and enforcement of this Act against all affected school 23 districts. 24 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 25 immediate importance, takes effect upon enactment. 26 Sec. 4. APPLICABILITY. This Act applies to school years 27 beginning on or after July 1, 2016. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill requires each school district and each accredited 32 nonpublic school to have a contractual relationship with at 33 least one licensed athletic trainer. 34 The bill may include a state mandate as defined in Code 35 -1- LSB 5467XS (2) 86 kh/rj 1/ 2
S.F. 2124 section 25B.3. The bill requires that the state cost of 1 any state mandate included in the bill be paid by a school 2 district from state school foundation aid received by the 3 school district under Code section 257.16. The specification 4 is deemed to constitute state compliance with any state mandate 5 funding-related requirements of Code section 25B.2. The 6 inclusion of this specification is intended to reinstate the 7 requirement of political subdivisions to comply with any state 8 mandates included in the bill. 9 The bill takes effect upon enactment and applies to school 10 years beginning on or after July 1, 2016. 11 -2- LSB 5467XS (2) 86 kh/rj 2/ 2
