If a nursing facility requires a security deposit 3 prior to an individual’s admission to the nursing facility, 4 the nursing facility shall, within thirty days from the date 5 the individual is discharged or transferred from the nursing 6 facility, return the security deposit to the individual less 7 any charges expended in accordance with the terms of the 8 nursing facility contract. 9 2. The department shall adopt rules to implement this 10 section. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill provides that if a nursing facility requires a 15 security deposit prior to an individual’s admission to the 16 nursing facility, the nursing facility shall, within 30 days 17 from the date the individual is discharged or transferred 18 from the nursing facility, return the security deposit to the 19 individual less any charges expended in accordance with the 20 terms of the nursing facility contract. The bill directs 21 the department of inspections and appeals to adopt rules to 22 implement the bill. 23 “Nursing facility” means an institution or a distinct 24 part of an institution housing three or more individuals not 25 related to the administrator or owner within the third degree 26 of consanguinity, which is primarily engaged in providing 27 health-related care and services, including rehabilitative 28 services, but which is not engaged primarily in providing 29 treatment or care for mental illness or an intellectual 30 disability, for a period exceeding 24 consecutive hours for 31 individuals who, because of a mental or physical condition, 32 require nursing care and other services in addition to room and 33 board. 34 -1- LSB 5647XS (2) 86 rh/nh 1/ 1
