S.F. 2109 DIVISION I 1 HEALTH AND HUMAN SERVICES 2 Section 1. MEDICAID. There is appropriated from the general 3 fund of the state to the department of human services for the 4 fiscal year beginning July 1, 2015, and ending June 30, 2016, 5 the following amount, or so much thereof as is necessary, to be 6 used for the purposes designated: 7 To supplement the appropriation made for medical assistance 8 program reimbursement and associated costs in 2015 Iowa Acts, 9 chapter 137, section 12, unnumbered paragraph 2: 10 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 80,000,000 11 Notwithstanding section 8.33, moneys appropriated in this 12 division that remain unobligated or unexpended at the close of 13 the fiscal year shall not revert but shall remain available 14 to be used for the purposes designated until the close of the 15 succeeding fiscal year. 16 Sec. 2. EFFECTIVE UPON ENACTMENT. This division of this 17 Act, being deemed of immediate importance, takes effect upon 18 enactment. 19 DIVISION II 20 DEPARTMENT OF CORRECTIONS 21 Sec. 3. GENERAL ADMINISTRATION. There is appropriated from 22 the general fund of the state to the department of corrections 23 for the fiscal year beginning July 1, 2015, and ending June 30, 24 2016, the following amount, or so much thereof as is necessary, 25 to be used for the purposes designated: 26 To supplement the appropriation made for general 27 administration, including salaries, support, maintenance, 28 employment of an education director to administer a 29 centralized education program for the correctional system, and 30 miscellaneous purposes in 2015 Iowa Acts, chapter 135, section 31 4, subsection 1, unnumbered paragraph 1: 32 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,900,000 33 It is the intent of the general assembly that a priority in 34 allocating the moneys appropriated in this section shall be 35 -1- LSB 5713SV (3) 86 rn/tm 1/ 6
S.F. 2109 to supplement the amounts otherwise appropriated in 2015 Iowa 1 Acts, chapter 135, section 3, subsection 1, for the operation 2 of the Mount Pleasant and Clarinda correctional facilities. 3 Notwithstanding section 8.33, moneys appropriated in this 4 division that remain unobligated or unexpended at the close of 5 the fiscal year shall not revert but shall remain available 6 to be used for the purposes designated until the close of the 7 succeeding fiscal year. 8 Sec. 4. EFFECTIVE UPON ENACTMENT. This division of this 9 Act, being deemed of immediate importance, takes effect upon 10 enactment. 11 DIVISION III 12 DEPARTMENT OF INSPECTIONS AND APPEALS 13 Sec. 5. INDIGENT DEFENSE. There is appropriated from the 14 general fund of the state to the department of inspections and 15 appeals for the fiscal year beginning July 1, 2015, and ending 16 June 30, 2016, the following amount, or so much thereof as is 17 necessary, to be used for the purposes designated: 18 To supplement the appropriation made for payments on behalf 19 of eligible adults and juveniles from the indigent defense 20 fund, in accordance with section 815.11, in 2015 Iowa Acts, 21 chapter 135, section 11, subsection 2: 22 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 23 Notwithstanding section 8.33, moneys appropriated in this 24 division that remain unobligated or unexpended at the close of 25 the fiscal year shall not revert but shall remain available 26 to be used for the purposes designated until the close of the 27 succeeding fiscal year. 28 Sec. 6. UTILITY COSTS. There is appropriated from the 34 general fund of the state to the department of administrative 35 -2- LSB 5713SV (3) 86 rn/tm 2/ 6
S.F. 2109 services for the fiscal year beginning July 1, 2015, and ending 1 June 30, 2016, the following amount, or so much thereof as is 2 necessary, to be used for the purposes designated: 3 To supplement the appropriation for utility costs made in 4 2015 Iowa Acts, chapter 141, section 1, subsection 1, paragraph 5 “b”: 6 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 610,039 7 Notwithstanding section 8.33, moneys appropriated in this 8 division that remain unobligated or unexpended at the close of 9 the fiscal year shall not revert but shall remain available 10 to be used for the purposes designated until the close of the 11 succeeding fiscal year. 12 Sec. 8. EFFECTIVE UPON ENACTMENT. This division of this 13 Act, being deemed of immediate importance, takes effect upon 14 enactment. 15 DIVISION V 16 REBUILD IOWA INFRASTRUCTURE FUND 17 Sec. 9. Section 8.55, subsection 2, Code 2016, is amended by 18 adding the following new paragraph: 19 NEW PARAGRAPH . 0a. The first thirty million dollars shall 20 be transferred to the rebuild Iowa infrastructure fund to be 21 used as provided in section 8.57, subsection 5. 22 Sec. 10. Section 8.55, subsection 2, paragraph a, Code 2016, 23 is amended to read as follows: 24 a. The first next sixty million dollars of the difference 25 between the actual net revenue for the general fund of the 26 state for the fiscal year and the adjusted revenue estimate for 27 the fiscal year shall be transferred to the taxpayers trust 28 fund. 29 Sec. 11. EFFECTIVE DATE. This division of this Act takes 30 effect July 1, 2017. 31 DIVISION VI 32 REBUILD IOWA INFRASTRUCTURE FUND —— ONE-TIME APPROPRIATION 33 Sec. 12. REBUILD IOWA INFRASTRUCTURE FUND APPROPRIATION. 34 There is appropriated from the general fund of the state to the 35 -3- LSB 5713SV (3) 86 rn/tm 3/ 6
S.F. 2109 rebuild Iowa infrastructure fund for the fiscal year beginning 1 July 1, 2015, and ending June 30, 2016, the following amount, 2 or so much thereof as is necessary, to be used as provided in 3 section 8.57: 4 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 30,000,000 5 Sec. 13. EFFECTIVE UPON ENACTMENT. This division of this 6 Act, being deemed of immediate importance, takes effect upon 7 enactment. 8 DIVISION VII 9 GAMING REVENUES —— GENERAL FUND 10 Sec. 14. Section 8.57, subsection 5, paragraph f, 11 subparagraph (1), subparagraph division (d), Code 2016, is 12 amended to read as follows: 13 (d) (i) For the fiscal year each fiscal year for the period 14 beginning July 1, 2013, and for each fiscal year thereafter 15 ending June 30, 2016 , the total moneys in excess of the moneys 16 deposited under this paragraph “f” in the revenue bonds debt 17 service fund, the revenue bonds federal subsidy holdback 18 fund, the vision Iowa fund, and the Iowa skilled worker and 19 job creation fund shall be deposited in the rebuild Iowa 20 infrastructure fund and shall be used as provided in this 21 section , notwithstanding section 8.60 . 22 (ii) For the fiscal year beginning July 1, 2016, and for 23 each fiscal year thereafter, the first twenty-five million of 24 the total moneys remaining in excess of the moneys deposited 25 under this paragraph “f” in the revenue bonds debt service 26 fund, the revenue bonds federal subsidy holdback fund, the 27 vision Iowa fund, and the Iowa skilled worker and job creation 28 fund shall be deposited in the general fund of the state. The 29 remaining moneys in excess of the moneys deposited under this 30 subparagraph subdivision (ii) in the general fund of the state 31 shall be deposited in the rebuild Iowa infrastructure fund and 32 shall be used as provided in this section, notwithstanding 33 section 8.60. 34 EXPLANATION 35 -4- LSB 5713SV (3) 86 rn/tm 4/ 6
S.F. 2109 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill relates to financial and regulatory matters by 3 supplementing appropriations for the fiscal year beginning July 4 1, 2015, and by making standing appropriations. The bill is 5 organized into divisions. 6 HEALTH AND HUMAN SERVICES. This division supplements 7 an appropriation from the general fund of the state to the 8 department of health and human services for the fiscal year 9 that begins July 1, 2015, for medical assistance program 10 reimbursement and associated costs. The supplemental 11 appropriation is $80 million, and nonreversion provisions are 12 made applicable. 13 The division is effective upon enactment. 14 DEPARTMENT OF CORRECTIONS. This division supplements 15 an appropriation from the general fund of the state to the 16 department of corrections for the fiscal year that begins 17 July 1, 2015, for general administration. The supplemental 18 appropriation is $1.9 million. The division provides that 19 priority in allocating the funds shall be to supplement other 20 amounts separately appropriated for the operation of the Mount 21 Pleasant and Clarinda correctional facilities. Nonreversion 22 provisions are made applicable. 23 The division takes effect upon enactment. 24 DEPARTMENT OF INSPECTIONS AND APPEALS. This division 25 supplements an appropriation from the general fund of the state 26 to the office of the state public defender of the department 27 of inspections and appeals for the fiscal year that begins 28 July 1, 2015, for payments from the indigent defense fund. 29 The supplemental appropriation is $3 million. Nonreversion 30 provisions are made applicable. 31 The division takes effect upon enactment. 32 DEPARTMENT OF ADMINISTRATIVE SERVICES. This division 33 supplements an appropriation from the general fund of the state 34 to the department of administrative services for the fiscal 35 -5- LSB 5713SV (3) 86 rn/tm 5/ 6
S.F. 2109 year that begins July 1, 2015, for payment of utility costs. 1 The supplemental appropriation is $610,039. Nonreversion 2 provisions were made applicable. 3 The division takes effect upon enactment. 4 REBUILD IOWA INFRASTRUCTURE FUND. This division provides 5 that the first $30 million of moneys in excess of the 6 maximum balance in the Iowa economic emergency fund shall be 7 transferred annually to the rebuild Iowa infrastructure fund to 8 be used as provided in Code section 8.57, subsection 5. 9 The division takes effect July 1, 2017. 10 REBUILD IOWA INFRASTRUCTURE FUND —— ONE-TIME APPROPRIATION. 11 This division makes a one-time appropriation of $30 million 12 from the general fund of the state to the rebuild Iowa 13 infrastructure fund for the fiscal year beginning July 1, 2015, 14 and ending June 30, 2016. 15 The division takes effect upon enactment. 16 GAMING REVENUES. This division provides that for the fiscal 17 year beginning July 1, 2016, and for each succeeding fiscal 18 year, the first $25 million of the total moneys remaining after 19 payments are deducted from appropriations made to the rebuild 20 Iowa infrastructure fund for revenue bond debt service, revenue 21 bond federal subsidy holdback, the vision Iowa fund, and the 22 Iowa skilled worker and job creation fund shall be deposited in 23 the general fund of the state. 24 -6- LSB 5713SV (3) 86 rn/tm 6/ 6
