S.F. 2105 Section 1. Section 388.4, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 5. A utility board established by a city 3 with more than one hundred seventy-five thousand population, 4 located in a county with more than four hundred thousand 5 population, shall submit to the city council for review and 6 approval, in advance of payment, each request for payment of 7 attorney fees and related litigation expenses in excess of ten 8 thousand dollars arising out of or related to any one civil 9 case or administrative proceeding to which the utility board or 10 the city utility, city utilities, or combined utility system 11 is a party. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill requires city utility boards in cities and 16 counties exceeding a specified population threshold to submit 17 advanced payment requests for certain expenses to the city 18 council for approval. 19 The bill provides that a utility board established by a city 20 with a population exceeding 175,000 residents and located in 21 a county with a population exceeding 400,000 residents must 22 submit to the city council for review and approval, in advance 23 of payment, each request for payment of attorney’s fees and 24 related litigation expenses in excess of $10,000 arising out of 25 or related to any one civil case or administrative proceeding 26 to which the utility board or the city utility, city utilities, 27 or combined utility system is a party. 28 -1- LSB 5662XS (2) 86 rn/sc 1/ 1
