S.F. 2090 Section 1. Section 99G.9, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4A. Commission a study, to be conducted by 3 an institution under the control of the state board of regents, 4 on the socioeconomic impacts of gambling on lottery games by 5 Iowans every four years beginning in calendar year 2017, and 6 issue a report on the study. The study shall be conducted by 7 employees of an institution under the control of the state 8 board of regents, and all costs related to the study shall be 9 paid by the authority. The study shall include information on 10 the impact of playing lottery games on problem gambling. The 11 board shall ensure that the results of each study are readily 12 accessible to the public. 13 Sec. 2. Section 99G.34, Code 2016, is amended to read as 14 follows: 15 99G.34 Open records —— exceptions. 16 1. The records of the authority shall be governed by the 17 provisions of chapter 22 , provided that, in addition to records 18 that may be kept confidential pursuant to section 22.7 , the 19 following records shall be kept confidential, unless except as 20 provided in subsection 2 or as otherwise ordered by a court, by 21 the lawful custodian of the records, or by another person duly 22 authorized to release such information: 23 1. a. Marketing plans, research data, and proprietary 24 intellectual property owned or held by the authority under 25 contractual agreements. 26 2. b. Personnel, vendor, and player social security or tax 27 identification numbers. 28 3. c. Computer system hardware, software, functional and 29 system specifications, and game play data files. 30 4. d. Security records pertaining to investigations and 31 intelligence-sharing information between lottery security 32 officers and those of other lotteries and law enforcement 33 agencies, the security portions or segments of lottery 34 requests for proposals, proposals by vendors to conduct 35 -1- LSB 5036XS (4) 86 ec/nh 1/ 3
S.F. 2090 lottery operations, and records of the security division of the 1 authority pertaining to game security data, ticket validation 2 tests, and processes. 3 5. e. Player name and address lists, provided that the 4 names and addresses of prize winners shall not be withheld. 5 6. f. Operational security measures, systems, or procedures 6 and building plans. 7 7. g. Security reports and other information concerning 8 bids or other contractual data, the disclosure of which would 9 impair the efforts of the authority to contract for goods or 10 services on favorable terms. 11 8. h. Information that is otherwise confidential obtained 12 pursuant to investigations as provided in section 99G.35 . 13 2. Records otherwise deemed confidential pursuant to this 14 section may be released for purposes of the socioeconomic 15 impact study required to be conducted pursuant to section 16 99G.9. Records that may be released for the study include 17 summary and aggregated information concerning the demographics 18 of players of lottery games, individual player data in a 19 form that does not disclose a player’s identity, and general 20 statistical information concerning the operation of lottery 21 games. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill requires the board of directors of the lottery 26 authority to commission a study on the socioeconomic impacts of 27 gambling on lottery games by Iowans every four years beginning 28 in calendar year 2017. The study shall be conducted by an 29 institution under the control of the state board of regents. 30 Code section 99G.34, concerning exceptions to open records 31 requirements, is amended to authorize the release of records 32 for purposes of conducting the socioeconomic study required by 33 the bill. The bill further provides that records which may be 34 released include summary and aggregated information on player 35 -2- LSB 5036XS (4) 86 ec/nh 2/ 3
