S.F. 2080 Section 1. Section 2.15, subsection 1, paragraph e, Code 1 2016, is amended to read as follows: 2 e. (1) Undertaking in-depth studies of governmental matters 3 within their assigned jurisdiction, not only for the purpose of 4 evaluating proposed legislation, but also for studying existing 5 laws and governmental operations and functions to determine 6 their usefulness and effectiveness, as provided in section 7 2.14 . 8 (2) (a) As part of the duties identified in paragraph “a” , 9 standing committees shall conduct a periodic review of chapters 10 of the Code corresponding to their assigned jurisdiction, and 11 make recommendations for additions to, deletions from, or 12 modifications of those provisions. The objective of the review 13 shall be to recommend to the general assembly the amendment and 14 reenactment of provisions of the Code in order to affirm and 15 revise current law by reflecting current practices, inserting 16 earlier omissions, deleting redundancies and inaccuracies, 17 deleting temporary language, resolving inconsistencies 18 and conflicts, updating ongoing provisions, and removing 19 ambiguities. 20 (b) The reviews shall be conducted pursuant to a schedule 21 determined by the legislative council, with the assistance of 22 the Code editor, such that approximately one-twelfth of the 23 Code shall undergo a review in any one year, and the entire 24 Code shall have undergone a review at the conclusion of a 25 twelve-year period. The reviews shall be conducted on an 26 ongoing and rotating basis. The chairperson of each standing 27 committee shall submit recommendations at the conclusion of 28 that committee’s review to the legislative services agency 29 for the drafting of proposed legislation to amend and reenact 30 portions of the Code. 31 (c) Standing committees may meet for purposes of the review 32 throughout the legislative session and during the legislative 33 interim if authorized by the legislative council. The legislative services 1 agency shall provide staff assistance as authorized by the 2 legislative council. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill requires the standing committees of the Iowa 7 general assembly to conduct a periodic review of Iowa Code 8 chapters corresponding to their assigned jurisdiction, and make 9 recommendations for additions, deletions, or modifications. 10 The bill provides that the objective of the review shall be to 11 recommend to the general assembly the amendment and reenactment 12 of provisions of the Code in order to affirm and revise 13 current law by reflecting current practices, inserting earlier 14 omissions, deleting redundancies and inaccuracies, deleting 15 temporary language, resolving inconsistencies and conflicts, 16 updating ongoing provisions, and removing ambiguities. 17 The bill provides that the legislative council shall 18 determine an ongoing review schedule, with the assistance of 19 the Iowa Code editor, such that approximately one-twelfth of 20 the Code shall undergo a review in any one year, and the entire 21 Code shall have undergone a review at the conclusion of a 22 12-year period. The chairperson of each standing committee 23 is directed to submit recommendations at the conclusion of 24 that committee’s review to the legislative services agency for 25 drafting of proposed legislation. 26 Procedurally, the bill provides that standing committees 27 may meet for purposes of the review throughout the legislative 28 session and during the legislative interim if authorized by 29 the legislative council, may conduct joint standing committee 30 meetings, and may be provided staffing assistance by the 31 legislative services agency as authorized by the legislative 32 council. 33 -2- LSB 5050XS (4) 86 rn/rj 2/ 2
