1.
Section
155A.27,
Code
2016,
is
amended
to
read

as
follows:

Requirements
for
prescription.

1.
To
be
valid,
each
prescription
drug
order
issued
4
or
dispensed
in
this
state
must
be
based
on
a
valid
5
patient-practitioner
relationship,
and:
6
1.
a.
If
written,
electronic,
or
facsimile,
shall
contain:
7
a.
(1)
The
date
of
issue.
8
b.
(2)
The
name
and
address
of
the
patient
for
whom,
or
the
9
owner
of
the
animal
for
which,
the
drug
is
dispensed.

c.
(3)
The
name,
strength,
and
quantity
of
the
drug,
11
medicine,
or
device
prescribed.

d.
(4)
The
directions
for
use
of
the
drug,
medicine,
or
13
device
prescribed.
14
e.
(5)
The
name,
address,
and
written
or
electronic
15
signature
of
the
practitioner
issuing
the
prescription.
16
f.
(6)
The
federal
drug
enforcement
administration
number,
17
if
required
under
chapter
124
.

If
electronic:

a.
(1)
The
practitioner
shall
ensure
that
the
electronic
20
system
used
to
transmit
the
electronic
prescription
has
21
adequate
security
and
system
safeguards
designed
to
prevent
and
22
detect
unauthorized
access,
modification,
or
manipulation
of
23
the
prescription.

b.
(2)
The
practitioner
shall
provide
verbal
verification
25
of
the
electronic
prescription
upon
the
request
of
the
26
pharmacy.

a.
c.
(1)
If
facsimile,
in
addition
to
the
28
requirements
of
subsection
1
paragraph
“a”
,
shall
contain
all
29
of
the
following:

(1)
(a)
The
identification
number
of
the
facsimile
machine
31
which
is
used
to
transmit
the
prescription.

(b)
The
time
and
date
of
transmission
of
the
33
prescription.

(c)
The
name,
address,
telephone
number,
and
facsimile

of
the
pharmacy
to
which
the
prescription
is
being

transmitted.

(2)
A
practitioner
shall
provide
verbal
verification
of

the
facsimile
prescription
upon
the
request
of
the
pharmacy.

4.
d.
If
oral,
the
practitioner
issuing
the
prescription
5
shall
furnish
the
same
information
required
for
a
written
6
prescription,
except
for
the
written
signature
and
address
7
of
the
practitioner.
Upon
receipt
of
an
oral
prescription,
8
the
pharmacist
shall
promptly
reduce
the
oral
prescription
to
9
a
written
format
by
recording
the
information
required
in
a
10
written
prescription.

2.
This
section
shall
not
be
interpreted
to
prohibit
12
a
pharmacist,
in
exercising
the
pharmacist’s
professional
13
judgment,
from
dispensing
additional
quantities
of
a
14
prescription
drug
up
to
the
total
number
of
dosage
units
15
authorized
by
the
prescriber
on
the
original
prescription
and
16
any
refills
of
the
prescription.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
19
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
the
requirements
for
each
21
prescription
drug
order
issued
or
dispensed
in
the
state
are
22
not
to
be
interpreted
to
prohibit
a
pharmacist,
in
exercising
23
the
pharmacist’s
professional
judgment,
from
dispensing
24
additional
quantities
of
a
prescription
drug
up
to
the
total
25
number
of
dosage
units
authorized
by
the
prescriber
on
the
26
original
prescription
and
any
refills
of
the
prescription.
