1.
NEW
SECTION
.
614.28A
Persons
without
valid
1
driver’s
licenses
or
financial
liability
coverage.

No
action
for
damages
for
death,
personal
injury,
or
3
property
damage
resulting
from
a
motor
vehicle
accident
or
4
collision
shall
be
brought
by
a
person
involved
in
the
accident
5
or
collision,
regardless
of
fault,
if
the
person,
at
the
time
6
of
the
accident
or
collision,
was
operating
a
motor
vehicle
7
with
a
denied,
canceled,
suspended,
or
revoked
driver’s
license
8
in
violation
of
section
321.218,
321A.32,
or
321J.21,
or
9
without
financial
liability
coverage
in
effect
for
the
vehicle
10
in
violation
of
section
321.20B,
subsection
1.

Sec.
2.
Section
726.6,
subsection
1,
Code
2016,
is
amended
12
by
adding
the
following
new
paragraph:

PARAGRAPH
.
i.
Knowingly
operates
a
motor
vehicle
with
14
a
denied,
canceled,
suspended,
or
revoked
driver’s
license
in
15
violation
of
section
321.218,
321A.32,
or
321J.21,
or
without
16
financial
liability
coverage
in
effect
for
the
vehicle
in
17
violation
of
section
321.20B,
subsection
1,
while
the
child
or
18
minor
is
a
passenger
in
the
vehicle.

EXPLANATION
20
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

If
a
person
operates
a
motor
vehicle
with
a
denied,
canceled,
23
suspended,
or
revoked
driver’s
license
or
without
financial
24
liability
coverage
in
effect
for
the
vehicle
and
an
accident
or
25
collision
occurs,
this
bill
prohibits
the
person
from
bringing
26
a
civil
action
for
property
damage,
personal
injury,
or
death
27
resulting
from
the
accident
or
collision,
regardless
of
fault.
28
In
addition,
the
bill
provides
that
knowingly
operating
a
29
motor
vehicle
with
a
denied,
canceled,
suspended,
or
revoked
30
driver’s
license
or
without
financial
liability
coverage
in
31
effect
for
the
vehicle,
while
a
child
under
14
years
of
age
32
or
a
minor
under
18
years
of
age
with
a
mental
or
physical
33
disability
is
a
passenger
in
the
vehicle,
constitutes
child
34
endangerment.
Child
endangerment
is
punishable
as
a
class
“B”

child

dies,
a
class
“C”
felony
if
the

child
or
minor
is
seriously
injured,
a
class
“D”
felony
if
the

child
or
minor

an
aggravated
misdemeanor
if
the

child
or
minor
is
not
injured.
