S.F. 2036 Section 1. Section 137D.1, subsection 3, Code 2016, is 1 amended to read as follows: 2 3. “Home food establishment” means a business on the 3 premises of a residence in which prepared food is created 4 for sale or resale, for consumption off the premises, if the 5 business has gross annual sales of prepared food of less than 6 twenty thirty-five thousand dollars. However, a home food 7 establishment does not include a residence in which food is 8 prepared to be used or sold by churches, fraternal societies, 9 charitable organizations, or civic organizations. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 This bill raises the ceiling on gross annual sales from 14 $20,000 to $35,000 for a food establishment to be considered a 15 home food establishment subject to licensure under Code chapter 16 137D. 17 -1- LSB 5155XS (1) 86 tr/sc 1/ 1
