S.F. 2003 Section 1. NEW SECTION . 481A.41 Blinds and stands for 1 hunting deer on public land —— identification. 2 1. A person shall not place a blind or stand for hunting 3 deer on public land unless the blind or stand is affixed with 4 and exhibits a metal plate which plainly shows the hunting 5 license number of the owner of the blind or stand. For a tree 6 blind or stand, the metal plate shall be affixed on the front 7 of the foot platform of the blind or stand on the third step up 8 from the ground. For a pop-up blind or stand, the metal plate 9 shall be affixed to or hung from the zipper head or access hook 10 of the pop-up blind or stand. 11 2. For purposes of this section, “blind or stand” means 12 a device or an enclosure used for concealment while hunting 13 deer, constructed either wholly or partially from man-made 14 materials, and used by a person who is hunting deer for the 15 purpose of hiding from sight. A “blind or stand” is not a 16 naturally occurring landscape feature or an arrangement of 17 natural or agricultural plant material that a deer hunter uses 18 for concealment. The natural resource commission shall adopt 19 rules pursuant to chapter 17A to implement this section. 20 Sec. 2. Section 805.8B, subsection 3, paragraph b, Code 21 2016, is amended to read as follows: 22 b. For violations of sections 481A.41, 481A.54 , 481A.69 , 23 481A.71 , 481A.72 , 482.6 , 483A.3 , 483A.6 , 483A.8A , 483A.19 , 24 483A.27 , and 483A.27A , the scheduled fine is twenty dollars. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill requires that a blind or stand placed on public 29 land for hunting deer be affixed with and exhibit a metal plate 30 which plainly shows the hunting license number of the owner of 31 the blind or stand. 32 For a tree blind or stand, the metal plate must be affixed 33 on the front of the foot platform of the blind or stand on the 34 third step up from the ground. A “blind or stand” does not include a 7 naturally occurring landscape feature or an arrangement of 8 natural or agricultural plant material that a deer hunter uses 9 for concealment. The natural resource commission is required 10 to adopt rules to implement the provisions of the bill.
