S.F. 20 Section 1. Section 8D.9, subsection 3, Code 2015, is amended 1 by striking the subsection. 2 Sec. 2. Section 8D.13, subsection 18, Code 2015, is amended 3 to read as follows: 4 18. Access to the network shall be offered to the department 5 of public safety , and the department of public defense , and the 6 department of homeland security and emergency management for 7 the purpose of establishing and operating a shared data-only 8 secure statewide network providing law enforcement, emergency 9 management, disaster service, emergency warning, and other 10 emergency information dissemination services to federal, state, 11 and local law enforcement agencies as provided in sections 80.9 12 and 80.9B , and local emergency management offices established 13 under the authority of sections 29C.9 and 29C.10 , and the 14 department of homeland security and emergency management . 15 Sec. 3. Section 8D.13, Code 2015, is amended by adding the 16 following new subsections: 17 NEW SUBSECTION . 18A. Access to the network shall be 18 offered to local law enforcement agencies for the purpose of 19 providing a secure statewide communications network for the 20 local law enforcement agencies and local emergency management 21 offices to facilitate more effective emergency response 22 services and to protect the health, safety, and welfare of the 23 people of this state. A local law enforcement agency or local 24 emergency management office shall be responsible for all costs 25 associated with the connection to and the use of the network, 26 excluding any costs associated with access provided through 27 the department of public safety and the department of homeland 28 security and emergency management as provided under subsection 29 18. 30 NEW SUBSECTION . 20. Access to the network shall be offered 31 to all public safety answering points established and operated 32 under chapters 34 and 34A, and facilities that receive E911 33 dispatches, for the purpose of establishing and operating a 34 secure statewide network for public safety answering points 35 -1- LSB 1206XS (3) 86 ad/sc 1/ 2
S.F. 20 and facilities that receive E911 dispatches to facilitate more 1 effective emergency response and to protect the health, safety, 2 and welfare of the people of this state. A public safety 3 answering point or facility that receives E911 dispatches shall 4 be responsible for all costs associated with the connection and 5 use of the network. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill allows access to the Iowa communications network 10 to local law enforcement agencies, public safety answering 11 points, and facilities that receive E911 dispatches for the 12 purpose of establishing and operating a secure statewide 13 network to facilitate more effective emergency responses. The 14 bill provides that the local law enforcement agency, local 15 emergency management office, public safety answering point, or 16 E911 dispatch facility is responsible for the costs associated 17 with connection and use of the network. The bill also adds a 18 reference to the department of homeland security and emergency 19 management regarding access to the network. 20 The bill eliminates a provision relating to restrictions 21 of certain public agencies to access the Iowa communications 22 network solely for homeland security communication purposes 23 and disaster communication purposes and only upon a state of 24 disaster emergency proclaimed by the governor. 25 -2- LSB 1206XS (3) 86 ad/sc 2/ 2
