IMPROVEMENT
PROGRAM
OPTION
FOR
FIRST
OFFENSE.
Notwithstanding
2
2012
Iowa
Acts,
chapter
1015,
section
5,
subsection
2,
by
3
July
1,
2015,
the
department
of
transportation
shall
initiate
4
rulemaking
to
amend
761
IAC
615.43
to
include
a
person
who
5
is
convicted
of
violating
section
321.372,
subsection
3,
for
6
the
first
time
among
the
persons
who
may
be
required,
in
lieu
7
of
driver’s
license
suspension,
to
attend
and
successfully
8
complete,
at
the
person’s
own
expense,
a
driver
improvement
9
program
approved
by
the
department,
subject
to
all
other
10
provisions
of
761
IAC
615.43.

Sec.
2.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
12
immediate
importance,
takes
effect
upon
enactment.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
rules
provide
that
the
department
of
transportation
17
(DOT)
may
require
certain
persons
to
participate
in
a
driver
18
improvement
program
in
lieu
of
driver’s
license
suspension.
19
This
bill
requires
the
DOT
to
initiate
rulemaking
to
include
20
persons
convicted
of
a
school
bus
safety
violation
for
the
21
first
time
on
the
list
of
persons
eligible
to
participate
in
22
a
driver
improvement
program.
23
The
bill
takes
effect
upon
enactment.
