S.F. 148 Section 1. NEW SECTION . 823.1 Short title. 1 This chapter shall be known and may be cited as the “Iowa 2 Fourth Amendment Protection Act”. 3 Sec. 2. NEW SECTION . 823.2 Prohibitions. 4 Notwithstanding any law, regulation, or order to the 5 contrary, an agency of this state, political subdivision 6 of this state, or employee of such an agency or political 7 subdivision acting in the employee’s official capacity, or 8 a corporation providing services on behalf of this state 9 or a political subdivision of this state shall not assist, 10 participate with, or provide material support or resources 11 to enable or facilitate, a federal agency in the collection 12 of electronic data or metadata of any person, without that 13 person’s informed consent, or without a warrant, based upon 14 probable cause, that particularly describes the person, 15 place, or thing to be searched or seized, or without acting in 16 accordance with a legally recognized exception to the warrant 17 requirements. 18 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 19 immediate importance, takes effect upon enactment. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill relates to assisting federal agencies in the 24 collection of data or metadata. 25 The bill names the legislation the “Iowa Fourth Amendment 26 Protection Act”. 27 The bill prohibits an agency of this state, political 28 subdivision of this state, or employee of an agency or 29 political subdivision acting in the employee’s official 30 capacity, or a corporation providing services on behalf of this 31 state or a political subdivision of this state from assisting, 32 participating with, or providing material support or resources 33 to enable or facilitate a federal agency in the collection of 34 electronic data or metadata of any person, without the person’s 35 -1- LSB 1625XS (6) 86 jm/rj 1/ 2
