S.F. 11 Section 1. NEW SECTION . 146A.1 Medical abortions —— 1 restrictions —— in-person administration —— penalties. 2 1. For the purpose of this section: 3 a. “Medical abortion” means the use of a medication 4 including but not limited to mifepristone or ulipristal acetate 5 to terminate a pregnancy. 6 b. “Physician” means a person licensed to practice medicine 7 and surgery or osteopathic medicine and surgery pursuant to 8 chapter 148. 9 2. a. Only a physician shall prescribe, dispense, or 10 administer any medication for the purpose of inducing a medical 11 abortion. 12 b. Any physician prescribing, dispensing, or administering 13 a medication for the purpose of inducing a medical abortion 14 shall also comply with all federal regulations relating to the 15 prescribing, dispensing, and administering of such medication. 16 c. A physician shall only administer a medication for 17 the purpose of inducing a medical abortion in person and in 18 a clinic or hospital with the capacity to provide surgical 19 intervention in cases resulting in an incomplete abortion or 20 severe bleeding. 21 3. A physician who knowingly performs a medical abortion in 22 violation of this section is guilty of a serious misdemeanor 23 and is subject to revocation of licensure pursuant to chapter 24 148. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 This bill defines “medical abortion” as the use of a 29 medication including but not limited to mifepristone or 30 ulipristal acetate to terminate a pregnancy. The bill provides 31 that only a physician shall prescribe, dispense, or administer 32 any medication for the purpose of inducing a medical abortion. 33 Additionally, the bill requires that any physician prescribing, 34 dispensing, or administering a medication for the purpose of 35 -1- LSB 1320XS (2) 86 pf/nh 1/ 2
S.F. 11 inducing a medical abortion shall comply with all federal 1 regulations relating to such medication; and a physician shall 2 only administer a medication for the purpose of inducing a 3 medical abortion in person and in a clinic or hospital with the 4 capacity to provide surgical intervention in cases resulting in 5 an incomplete abortion or severe bleeding. 6 A physician who knowingly performs a medical abortion in 7 violation of the bill is guilty of a serious misdemeanor and 8 is subject to revocation of licensure pursuant to Code chapter 9 148.
