H.F. _____ Section 1. Section 257.8, subsections 1 and 2, Code 2015, 1 are amended to read as follows: 2 1. State percent of growth. The state percent of growth 3 for the budget year beginning July 1, 2012, is two percent. 4 The state percent of growth for the budget year beginning July 5 1, 2013, is two percent. The state percent of growth for the 6 budget year beginning July 1, 2014, is four percent. The state 7 percent of growth for each subsequent budget year shall be 8 established by statute which shall be enacted within thirty 9 days of the submission in the year preceding the base year of 10 the governor’s budget under section 8.21 as provided in this 11 subsection . The statute establishing the state percent of 12 growth for a budget year beginning July 1 of an odd-numbered 13 calendar year shall be enacted within thirty days of the 14 submission of the governor’s budget under section 8.21 in that 15 odd-numbered calendar year. The statute establishing the state 16 percent of growth for a budget year beginning July 1 of an 17 even-numbered calendar year shall be enacted during the regular 18 legislative session preceding the base year. The establishment 19 of the state percent of growth for a budget year shall be the 20 only subject matter of the bill which enacts the state percent 21 of growth for a budget year. 22 2. Categorical state percent of growth. The categorical 23 state percent of growth for the budget year beginning July 24 1, 2012, is two percent. The categorical state percent of 25 growth for the budget year beginning July 1, 2013, is two 26 percent. The categorical state percent of growth for the 27 budget year beginning July 1, 2014, is four percent. The 28 categorical state percent of growth for each budget year shall 29 be established by statute which shall be enacted within thirty 30 days of the submission in the year preceding the base year of 31 the governor’s budget under section 8.21 as provided in this 32 subsection . The statute establishing the categorical state 33 percent of growth for a budget year beginning July 1 of an 34 odd-numbered calendar year shall be enacted within thirty days 35 -1- LSB 1827YC (4) 86 md/sc 1/ 3
H.F. _____ of the submission of the governor’s budget under section 8.21 1 in that odd-numbered calendar year. The statute establishing 2 the categorical state percent of growth for a budget year 3 beginning July 1 of an even-numbered calendar year shall be 4 enacted during the regular legislative session preceding the 5 base year. The establishment of the categorical state percent 6 of growth for a budget year shall be the only subject matter of 7 the bill which enacts the categorical state percent of growth 8 for a budget year. The categorical state percent of growth 9 may include state percents of growth for the teacher salary 10 supplement, the professional development supplement, the early 11 intervention supplement, and the teacher leadership supplement. 12 Sec. 2. Section 257.40, subsection 1, Code 2015, is amended 13 to read as follows: 14 1. The board of directors of a school district requesting to 15 use a modified supplemental amount for programs for returning 16 dropouts and dropout prevention shall submit requests for a 17 modified at-risk supplemental amount, including budget costs, 18 to the department not later than December 15 of the year 19 February 10 preceding the budget year during which the program 20 will be offered. The department shall review the request and 21 shall prior to January 15 March 10 either grant approval for 22 the request or return the request for approval with comments 23 of the department included. An unapproved request for a 24 program may be resubmitted with modifications to the department 25 not later than February 1 March 25 . Not later than February 26 15 April 10 , the department shall notify the department of 27 management and the school budget review committee of the names 28 of the school districts for which programs using a modified 29 supplemental amount for funding have been approved and the 30 approved budget of each program listed separately for each 31 school district having an approved request. 32 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 33 immediate importance, takes effect upon enactment. 34 Sec. 4. APPLICABILITY. This Act applies to the 35 -2- LSB 1827YC (4) 86 md/sc 2/ 3
H.F. _____ establishment of the state percent of growth and the 1 categorical state percent of growth for school budget years 2 beginning on or after July 1, 2016. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill modifies the requirements for enacting the state 7 percent of growth and the categorical state percent of growth 8 under Code section 257.8. 9 Current law requires the state percent of growth and the 10 categorical state percent of growth to be established by 11 statute within 30 days of the submission of the governor’s 12 budget in the year preceding the base year. 13 The bill requires the statute establishing the state percent 14 of growth and the categorical state percent of growth for 15 a budget year beginning July 1 of an odd-numbered calendar 16 year to be enacted within 30 days of the submission of the 17 governor’s budget in that odd-numbered calendar year. The 18 bill requires the statute establishing the state percent of 19 growth and the categorical state percent of growth for a budget 20 year beginning July 1 of an even-numbered calendar year to be 21 enacted during the regular legislative session preceding the 22 base year. 23 The bill amends Code section 257.40 relating to dropout 24 prevention funding to address changes in the timing of 25 establishment of the state percent of growth. 26 The bill takes effect upon enactment and applies to 27 the establishment of the state percent of growth and the 28 categorical state percent of growth for school budget years 29 beginning on or after July 1, 2016. 30 -3- LSB 1827YC (4) 86 md/sc 3/ 3
