Provision
of
veterinary
services.

1.
A
person,
including
a
corporation,
limited
liability

company,
or
partnership,
established
on
or
after
July
1,
1994,
5
other
than
either
a
professional
corporation
organized
under
6
chapter
496C
or
a
veterinarian
licensed
under
this
chapter
,
7
shall
not
provide
veterinary
medical
services,
own
a
veterinary
8
clinic,
or
practice
veterinary
medicine
in
this
state,
except
9
as
otherwise
provided
in
this
chapter
.
However,
this
section
10

Subsection
1
shall
not
prohibit
do
any
of
the
following:

a.
Apply
to
a
veterinarian
licensed
under
this
chapter,

a
partnership
formed
under
chapter
486A
and
composed
of

licensed
veterinarians,
a
limited
liability
partnership
formed

under
chapter
486A
and
composed
of
licensed
veterinarians,
a
15
professional
limited
liability
company
organized
under
chapter
16
489
and
engaging
in
the
practice
of
veterinary
medicine,
or
17
a
professional
corporation
organized
under
chapter
496C
and
18
engaging
in
the
practice
of
veterinary
medicine.

b.
Prohibit
a
person
from
owning
an
interest
in
real
20
property
or
a
building
where
a
veterinary
clinic
is
located,
if
21
veterinary
medical
services
or
a
veterinary
medicine
practice
22
is
conducted
by
at
the
clinic
by
a
professional
corporation
or
23
a
veterinarian
licensed
under
this
chapter
person
described
in

paragraph
“a”
.

constitute
agreement
with

BILL.
This
bill
amends
the
Iowa
veterinary
practice
Act
29
(Code
chapter
169)
by
allowing
certain
partnerships
composed
30
of
licensed
veterinarians
and
a
professional
limited
liability
31
company
(PLLC)
to
(1)
provide
veterinary
medical
services,
(2)
32
own
a
veterinary
clinic,
or
(3)
practice
veterinary
medicine
33
in
this
state.
The
purpose
of
a
PLLC
is
to
engage
in
the
34
practice
of
a
specific
profession
by
a
licensed
individual
or
a

partnership
of
licensed
individuals
(Code
section
489.1102).

The
bill
also
provides
that
any
person
may
own
an
interest
in

real
property
or
a
building
where
a
clinic
is
located,
so
long

as
the
partnership
or
professional
limited
liability
company
4
provides
services
or
conducts
a
practice
at
the
clinic.

CURRENT
LAW.
With
few
exceptions,
a
person
other
than
a
6
licensed
veterinarian
is
prohibited
from
providing
veterinary
7
medical
services,
owning
a
veterinary
clinic,
or
practicing
8
veterinary
medicine
in
this
state
(Code
section
169.4A).
9
The
prohibition
expressly
applies
to
an
entity
including
10
a
corporation,
limited
liability
company,
or
partnership
11
established
on
or
after
July
1,
1994.
However,
the
prohibition
12
does
not
apply
to
either
a
professional
corporation
or
a
13
licensed
veterinarian.
It
also
does
not
prevent
a
person
from
14
owning
an
interest
in
real
property
or
a
building
where
a
15
veterinary
clinic
is
located,
so
long
as
the
veterinary
medical
16
services
or
veterinary
practice
is
conducted
by
a
professional
17
corporation
or
licensed
veterinarian.
