H.F. _____ Section 1. Section 20.22, subsection 7, paragraph c, Code 1 2015, is amended to read as follows: 2 c. The interests and welfare of the public, the ability of 3 the public employer to finance economic adjustments without 4 raising any tax, and the effect of such adjustments on the 5 normal standard of services. 6 Sec. 2. Section 20.22, subsection 7, paragraph d, Code 2015, 7 is amended by striking the paragraph. 8 Sec. 3. APPLICABILITY. This Act applies to binding 9 arbitrations pursuant to chapter 20 entered into on or after 10 the effective date of this Act. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill modifies the factors that an arbitrator must 15 consider in the arbitration of a public employee collective 16 bargaining agreement. 17 Current law requires an arbitrator to consider the ability 18 of the public employer to finance economic adjustments. The 19 bill requires an arbitrator to consider the ability of the 20 public employer to finance economic adjustments without raising 21 any tax. 22 The bill strikes a requirement that the arbitrator consider 23 the power of the public employer to levy taxes and appropriate 24 funds for the conduct of its operations. 25 The bill applies to binding arbitrations pursuant to Code 26 chapter 20 entered into on or after the effective date of the 27 bill. 28 -1- LSB 1926YC (2) 86 je/rj 1/ 1
