The fee set forth in subsection 2 , paragraph “k” 5 “m” , shall not be charged on any property transferred to a 6 testamentary trust from an estate that has been administered 7 in this state and for which court costs have been assessed and 8 paid. 9 4. The clerk shall charge the filing and docketing fee set 10 forth in section 602.8105, subsection 1, paragraph “a” , for the 11 filing and docketing of a petition by an interested third party 12 against an original party to a probate matter. The fee shall 13 be deposited in the account established in section 602.8108. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to the fees the clerk of the probate court 18 charges in connection with certain probate matters. 19 For services performed in short form probate and probate 20 of a will without administration, the bill increases the 21 fee from $15.00 to the civil filing and docketing fee set 22 forth in Code section 602.8105(1)(a), or $185.00. The bill 23 establishes that for services performed in testamentary trust 24 administration under Code chapter 633, when jurisdiction is 25 invoked under Code chapter 633A, or for services performed in a 26 guardianship, standby guardianship, or combined guardianship 27 and conservatorship, the clerk shall charge the civil filing 28 and docketing fee set forth in Code section 602.8105(1)(a), or 29 $185.00. 30 The bill requires the clerk to charge $50.00 for the 31 safekeeping of a will. For services performed in small 32 estate administration, the bill increases the fee from $15.00 33 to $50.00. For providing a certificate and seal, the bill 34 increases the fee from $10.00 to $20.00. For printing or 35 -3- LSB 1220XD (8) 86 jh/rj 3/ 4

S.F. _____ H.F. _____ making a copy, the clerk is required to charge $0.50 per page. 1 For certifying a change in title, the bill increases the fee 2 from $20.00 to $50.00. For issuing a commission to appraisers, 3 the bill increases the fee from $2.00 to $100.00. 4 For other services performed, the bill provides that the 5 applicable fee, which is determined based on the value of the 6 estate, shall be calculated based on the value of the gross 7 estate. 8 The bill provides that if an interested third party files 9 a petition against an original party in a probate matter, the 10 clerk shall charge the civil filing and docketing fee set forth 11 in Code section 602.8105(1)(a), or $185.00. 12 -4- LSB 1220XD (8) 86 jh/rj 4/ 4
