H.F. _____ Section 1. DIRECTIVES TO DEPARTMENT OF HUMAN SERVICES 1 —— FEDERAL SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM (SNAP) 2 ELIGIBILITY. 3 1. Beginning July 1, 2015, the department of human services 4 shall eliminate categorical eligibility for the federal 5 supplemental nutrition assistance program. 6 2. The department of human services shall instead implement 7 income eligibility for the program at 130 percent of the 8 federal poverty level and shall implement the asset test for 9 eligibility, consistent with SNAP requirements. The department 10 shall include as many food assistance households as is allowed 11 by federal law. The eligibility provisions shall conform to 12 all federal requirements including requirements addressing 13 individuals who are incarcerated or otherwise ineligible. 14 3. The department of human services shall request federal 15 approval of any state plan amendment necessary to implement the 16 SNAP provisions under the provisions of this Act. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to food assistance program eligibility 21 requirements. 22 The bill directs the department of human services (DHS) 23 to eliminate categorical eligibility for the food assistance 24 program and to instead implement income eligibility for 25 the program at 130 percent of the federal poverty level 26 and an asset test for eligibility, consistent with federal 27 supplemental nutrition assistance program (SNAP) requirements. 28 The bill requires DHS to request federal approval of any 29 state plan amendment necessary to implement the SNAP provisions 30 under the bill. 31 -1- LSB 1598YC (5) 86 rh/nh 1/ 1
