H.F. _____ Section 1. Section 232.116, subsection 1, Code 2016, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . p. The court finds there is clear and 3 convincing evidence that the child was conceived as the result 4 of sexual abuse as defined in section 709.1, and the biological 5 parent against whom the sexual abuse was perpetrated requests 6 termination of the parental rights of the biological parent who 7 perpetrated the sexual abuse. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill provides as one of the grounds for termination of 12 parental rights under Code chapter 232 (juvenile justice) that 13 the court finds there is clear and convincing evidence that 14 the child was conceived as the result of sexual abuse, and the 15 biological parent against whom the sexual abuse was perpetrated 16 requests termination of the parental rights of the biological 17 parent who perpetrated the sexual abuse. 18 -1- LSB 6024YC (2) 86 pf/nh 1/ 1
