S.F. _____ H.F. _____ Section 1. Section 261.86, subsection 3, Code 2015, is 1 amended to read as follows: 2 3. a. An eligible member of the national guard, attending 3 an institution as provided in subsection 1 , paragraph “d” , as 4 a full-time student, shall not receive educational assistance 5 under this section for more than eight semesters, or if 6 attending as a part-time student for not more than sixteen 7 semesters, one hundred twenty credit hours of undergraduate 8 study , or the trimester or quarter equivalent . A national 9 guard member who has met the educational requirements for a 10 baccalaureate degree is ineligible for educational assistance 11 under this section . 12 b. A member of the national guard who received educational 13 assistance under this section prior to July 1, 2015, shall 14 be deemed to have received educational assistance for the 15 following number of credit hours for educational assistance 16 received before that date: 17 (1) For each semester that the member received educational 18 assistance while attending an institution as a full-time 19 student, twelve credit hours. 20 (2) For each semester that the member received educational 21 assistance while attending an institution as a part-time 22 student, six credit hours. 23 (3) For each trimester or quarter that the member received 24 educational assistance while attending an institution as a 25 full-time or part-time student, the number of credit hours that 26 are determined to be the semester equivalent by the college 27 student aid commission. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill makes changes to program limitations within the 32 national guard educational assistance program. 33 Under current law, participation in the national guard 34 educational assistance program is limited by semesters of 35 -1- LSB 1327XD (2) 86 aw/sc 1/ 2

The bill 1 replaces these limitations by providing that an eligible member 2 of the Iowa national guard may not receive assistance under the 3 program for more than 120 credit hours of undergraduate study. 4 The bill includes transition provisions relating to educational 5 assistance received under the program prior to July 1, 2015. 6 -2- LSB 1327XD (2) 86 aw/sc 2/ 2
