H.F. _____ Section 1. Section 670.7, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 5. A governmental entity established in 3 chapter 466B or chapter 468, subchapter I, II, III, or IV, 4 including but not limited to a council, authority, center, or 5 district, shall be deemed to be a municipality as defined in 6 this chapter only for the purpose of joining a local government 7 risk pool as provided in this section. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to local government risk pools. 12 Under current Code section 670.7, the governing body of a 13 municipality, as defined in Code section 670.1, may join and 14 pay funds into a local government risk pool to protect itself 15 against any or all tort liability. 16 The bill provides that governmental entities established 17 in Code chapter 466B and Code chapter 468, subchapters I 18 through IV, shall be deemed to be municipalities for the 19 purpose of joining a local government risk pool to protect 20 themselves against tort liability. Governmental bodies 21 established in Code chapter 466B include the water resources 22 coordinating council, watershed management authorities, 23 the watershed planning advisory council, the Iowa nutrient 24 research center, and the Iowa nutrient research center advisory 25 council.
