NEW SECTION . 1.15A Criminal jurisdiction —— Sac 1 and Fox Indian settlement. 2 Notwithstanding any other provision of law to the contrary, 3 the state of Iowa tenders to the United States any and all 4 criminal jurisdiction which the state of Iowa has over criminal 5 offenses committed by or against Indians on the Sac and Fox 6 Indian settlement in Tama, Iowa, and that as soon as the 7 United States accepts and assumes such criminal jurisdiction 8 previously conferred to the state of Iowa by the United States, 9 all criminal jurisdiction on the part of the state of Iowa over 10 criminal offenses committed by or against Indians on the Sac 11 and Fox Indian settlement in Tama, Iowa, shall cease. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the criminal jurisdiction of the Sac and 16 Fox Indian settlement. 17 The bill specifies that the state of Iowa tenders to the 18 United States any and all criminal jurisdiction which the state 19 of Iowa has over criminal offenses committed by or against 20 Indians on the Sac and Fox Indian settlement in Tama, Iowa. 21 The bill further specifies that as soon as the United States 22 accepts and assumes such criminal jurisdiction previously 23 conferred to the state of Iowa by the United States, all 24 criminal jurisdiction on the part of the state of Iowa over 25 criminal offenses committed by or against Indians on the Sac 26 and Fox Indian settlement in Tama, Iowa, shall cease. 27 -1- LSB 5158YC (3) 86 jm/rj 1/ 1
