There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. H.F. _____ apply: 1 (a) The demonstration projects shall utilize water quality 2 practices as described in the latest revision of the document 3 entitled “Iowa Nutrient Reduction Strategy” initially presented 4 in November 2012 by the department of agriculture and land 5 stewardship, the department of natural resources, and Iowa 6 state university of science and technology. 7 (b) The division shall implement demonstration projects 8 as provided in subparagraph division (a) by providing 9 for participation by persons who hold a legal interest in 10 agricultural land used in farming. To every extent practical, 11 the division shall provide for collaborative participation by 12 such persons who hold a legal interest in agricultural land 13 located within the same subwatershed. 14 (c) The division shall implement a demonstration project on 15 a cost-share basis as determined by the division. However, the 16 state’s share of the amount shall not exceed 50 percent of the 17 estimated cost of establishing the practice as determined by 18 the division or 50 percent of the actual cost of establishing 19 the practice, whichever is less. 20 (d) The demonstration projects shall be used to educate 21 other persons about the feasibility and value of establishing 22 similar water quality practices. The division shall promote 23 field day events for purposes of allowing interested persons to 24 establish water quality practices on their agricultural land. 25 (e) The division shall conduct water quality evaluations 26 within supported subwatersheds. Within a reasonable period 27 after accumulating information from such evaluations, the 28 division shall create an aggregated database of water quality 29 practices. Any information identifying a person holding a 30 legal interest in agricultural land or specific agricultural 31 land shall be a confidential record under section 22.7 . 32 (4) The moneys appropriated in this lettered paragraph 33 shall be used to support education and outreach in a manner 34 that encourages persons who hold a legal interest in 35 -2- LSB 1025HB (3) 86 ec/tm 2/ 13
H.F. _____ agricultural land used for farming to implement water quality 1 practices, including the establishment of such practices in 2 watersheds generally, and not limited to subwatersheds or 3 high-priority watersheds. 4 (5) The moneys appropriated in this lettered paragraph 5 may be used to contract with persons to coordinate the 6 implementation of efforts provided in this paragraph. 7 (6) The moneys appropriated in this lettered paragraph 8 may be used by the department to support urban soil and water 9 conservation efforts, which may include but are not limited 10 to management practices related to bioretention, landscaping, 11 the use of permeable or pervious pavement, and soil quality 12 restoration. The moneys shall be allocated on a cost-share 13 basis as provided in chapter 161A. 14 (7) Notwithstanding any other provision of law to the 15 contrary, the department may use moneys appropriated in 16 this lettered paragraph to carry out the provisions of this 17 paragraph on a cost-share basis in combination with other 18 moneys available to the department from a state or federal 19 source. 20 (8) Not more than 10 percent of the moneys appropriated 21 each fiscal year in this lettered paragraph may be used for 22 costs of administration and implementation of the water quality 23 initiative administered by the soil conservation division. 24 b. REVERSION. For purposes of section 8.33, unless 18 specifically provided otherwise, unencumbered or unobligated 19 moneys made from an appropriation in this division of this Act 20 shall not revert but shall remain available for expenditure for 21 the purposes designated until the close of the fiscal year that 22 ends three years after the end of the fiscal year for which the 23 appropriation is made. However, if the project or projects for 24 which such appropriation was made are completed in an earlier 25 fiscal year, unencumbered or unobligated moneys shall revert at 26 the close of that same fiscal year. 27 DIVISION II 28 MISCELLANEOUS APPROPRIATIONS 29 Sec. 3. REVENUE BONDS CAPITALS II FUND. 30 1. There is appropriated from the revenue bonds capitals 31 II fund created in section 12.88A to the department of 32 administrative services for the fiscal year beginning July 33 1, 2015, and ending June 30, 2016, the following amount, or 34 so much thereof as is necessary, to be used for the purposes 35 -9- LSB 1025HB (3) 86 ec/tm 9/ 13

Any remaining unobligated or unencumbered balance in 4 the revenue bonds capitals II fund created in section 12.88A 5 at the close of the fiscal year beginning July 1, 2015, is 6 appropriated to the department of administrative services for 7 the fiscal year beginning July 1, 2016, for major maintenance 8 projects. 9 DIVISION III 10 CHANGES TO PRIOR APPROPRIATIONS 11 Sec. 4. 2008 Iowa Acts, chapter 1179, section 20, as amended 12 by 2009 Iowa Acts, chapter 173, section 25, and 2013 Iowa Acts, 13 chapter 142, section 41, is amended to read as follows: 14 SEC. 20. REVERSION. 15 1. Except as provided in subsections 2 through 4 and 16 notwithstanding section 8.33 , moneys appropriated in this 17 division of this Act for the fiscal year beginning July 1, 18 2008, and ending June 30, 2009, shall not revert at the close 19 of the fiscal year for which they are appropriated but shall 20 remain available for the purposes designated until the close of 21 the fiscal year that begins July 1, 2012, or until the project 22 for which the appropriation was made is completed, whichever 23 is earlier. 24 2. Notwithstanding section 8.33 , moneys appropriated in 25 section 18, subsection 9, paragraph “a”, of this division as 26 amended by 2009 Iowa Acts, chapter 173, section 24, that remain 27 unencumbered or unobligated at the close of the fiscal year for 28 which they were appropriated shall not revert but shall remain 29 available for the purposes designated until the close of the 30 fiscal year that begins July 1, 2017, or until the project for 31 which the appropriation was made is completed, whichever is 32 earlier. 33 3. Notwithstanding section 8.33 , moneys appropriated in 34 section 18, subsection 1, paragraph “h”, of this division of 35 -10- LSB 1025HB (3) 86 ec/tm 10/ 13
H.F. _____ this Act as amended by 2009 Iowa Acts, chapter 173, section 1 23, that remain unencumbered or unobligated at the close of 2 the fiscal year for which the appropriation was made shall not 3 revert but shall remain available for the purpose designated 4 until the close of the fiscal year that begins July 1, 2013, 5 or until the project for which the appropriation was made is 6 completed, whichever is earlier. 7 4. Notwithstanding section 8.33 , moneys appropriated to the 8 department of economic development in section 18 , subsection 4, 9 paragraph “a”, of this division of this Act as amended by 2009 10 Iowa Acts, chapter 173, section 24, and 2011 Iowa Acts, chapter 11 133, section 34, that remain unencumbered or unobligated at the 12 close of the fiscal year for which the appropriation was made 13 shall not revert but shall remain available for the purpose 14 designated until the close of the fiscal year that begins July 15 1, 2014, or until the project for which the appropriation was 16 made is completed, whichever is earlier. 17 5. Notwithstanding section 8.33, moneys appropriated to the 18 department of economic development in section 18, subsection 4, 19 paragraph “b”, of this division of this Act as amended by 2009 20 Iowa Acts, chapter 173, section 24, and 2011 Iowa Acts, chapter 21 133, section 34, that remain unencumbered or unobligated at the 22 close of the fiscal year for which the appropriation was made 23 shall not revert but shall remain available for the purpose 24 designated until the close of the fiscal year that begins July 25 1, 2016, or until the project for which the appropriation was 26 made is completed, whichever is earlier. 27 Sec. 5. 2011 Iowa Acts, chapter 133, section 2, is amended 28 to read as follows: 29 SEC. 2. REVERSION. 30 1. Notwithstanding section 8.33, moneys appropriated in 7 section 1, subsection 10, paragraph “c”, as amended by 2012 8 Iowa Acts, chapter 1140, section 15, unless specifically 9 provided otherwise, that remain unencumbered or unobligated at 10 the close of the fiscal year beginning July 1, 2014, shall not 11 revert but shall remain available for the purposes designated 12 until the close of the fiscal year that begins July 1, 2017. 13 Sec. 6. 2014 Iowa Acts, chapter 1136, section 1, subsection 14 7, paragraph d, is amended to read as follows: 15 d. EFFECTIVE UPON ENACTMENT. H.F. _____ related matters. The bill is organized by divisions. 1 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 2 division appropriates project funding for FY 2015-2016 from 3 the rebuild Iowa infrastructure fund for projects for the 4 departments of administrative services, agriculture and 5 land stewardship, cultural affairs, human services, natural 6 resources, public defense, public safety, and transportation, 7 and for the economic development authority, Iowa veterans home, 8 treasurer of state, and the board of regents. The division 9 appropriates project funding for FY 2016-2017 from the rebuild 10 Iowa infrastructure fund for projects for the departments of 11 agriculture and land stewardship, cultural affairs, human 12 services, natural resources, and transportation, and for the 13 economic development authority, Iowa veterans home, treasurer 14 of state, and the board of regents. 15 DIVISION II —— MISCELLANEOUS APPROPRIATIONS. This division 16 appropriates project funding for FY 2015-2016 from the revenue 17 bonds capitals II fund for the department of administrative 18 services. Any remaining moneys in the revenue bonds capitals 19 II fund at the close of FY 2015-2016 is appropriated in the 20 following fiscal year for project funding for the department of 21 administrative services. 22 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 23 division provides for the reversion of certain unencumbered or 24 unobligated moneys appropriated from the FY 2009 tax-exempt 25 bond proceeds restricted capital funds account to the 26 economic development authority for FY 2008-2009 and for 27 moneys appropriated from the rebuild Iowa infrastructure fund 28 in FY 2011-2012 and FY 2012-2013 to the board of regents. 29 The division also makes changes to the amounts of moneys 30 appropriated from the rebuild Iowa infrastructure fund to the 31 board of regents for a project at the university of northern 32 Iowa for FY 2015-2016, FY 2016-2017, and FY 2017-2018. 33 This division takes effect upon enactment. 34 -13- LSB 1025HB (3) 86 ec/tm 13/ 13
