H.F. _____ Section 1. Section 29C.20B, Code 2015, is amended by 1 striking the section and inserting in lieu thereof the 2 following: 3 29C.20B Disaster case management grant fund and program. 4 1. a. A disaster case management grant fund is created 5 in the state treasury for the use of the executive council. 6 Moneys in the fund may be expended following the governor’s 7 proclamation of a state of disaster emergency or the 8 declaration of a major disaster by the president of the United 9 States. 10 b. The executive council may make financial grants to meet 11 disaster-related case management needs of disaster-affected 12 individuals. The aggregate total of grants awarded shall 13 not be more than one million dollars during a fiscal year. 14 However, within the same fiscal year, additional funds may 15 be specifically authorized by the executive council to meet 16 additional needs. Of the one million dollar aggregate total, 17 fifty thousand dollars may be expended for contract entity 18 staff support, and fifty thousand dollars may be expended for 19 case management training and continuing training. 20 c. The department of human services shall work with the 21 department of homeland security and emergency management 22 and, as selected by the department of human services, a 23 representative of nonprofit, voluntary, and faith-based 24 organizations active in disaster recovery and response to 25 establish a statewide system of disaster case management 26 to be activated following the governor’s proclamation of a 27 disaster emergency or the declaration of a major disaster by 28 the president of the United States for individual assistance 29 purposes. 30 2. The department of human services shall administer 31 disaster case management grants. The department of human 32 services, in conjunction with the department of homeland 33 security and emergency management, shall establish a disaster 34 case management program and adopt rules pursuant to chapter 17A 35 -1- LSB 2329YC (3) 86 tm/rj 1/ 5
H.F. _____ necessary to administer the program. The executive council 1 shall use grant moneys to reimburse the department of human 2 services for actual expenses associated with the administration 3 of the grants. Under the program, the department of human 4 services shall coordinate case management services locally 5 through one or more contracted entities. The department 6 of human services may implement an ongoing contract with a 7 provider of a statewide program with local offices throughout 8 the state to serve as the local administrative entity for the 9 grant program to allow implementation of the program with 10 minimal delay following a governor’s proclamation of a state of 11 disaster emergency or a declaration of a major disaster by the 12 president of the United States. 13 3. The department of human services, in conjunction with the 14 department of homeland security and emergency management and a 15 representative of the Iowa voluntary organizations active in 16 disaster, shall adopt rules pursuant to chapter 17A to create 17 coordination mechanisms and standards for the establishment 18 and implementation of a statewide system of disaster case 19 management. The rules adopted by the department of human 20 services for the program shall include but are not limited to 21 all of the following: 22 a. If a local administrative entity is under contract with 23 the state to provide other services or is implementing a state 24 or federal program and the contract contains a sufficient 25 surety bond or other adequate financial responsibility 26 provisions, the department shall accept the existing surety 27 bond or financial responsibility provisions in lieu of applying 28 a new or additional surety bond or financial responsibility 29 requirement. 30 b. Authorization for the local administrative entity to draw 31 down grant funding to pay valid claims on at least a weekly 32 basis. 33 c. Disaster case management standards. 34 d. H.F. _____ e. Reporting requirements. 1 f. Eligibility criteria. 2 g. Coordination mechanisms necessary to carry out the 3 services provided. 4 h. Development of formal working relationships with agencies 5 and creation of interagency agreements for those considered to 6 provide disaster case management services. 7 i. Establishment of nonduplication of benefits policies and 8 mechanisms for the exchange of information between agencies to 9 ensure compliance with the federal Health Insurance Portability 10 and Accountability Act of 1996, Pub. L. No. 104-191, 110 Stat. 11 1936 (1996). 12 j. Referral to all known available services for individuals 13 from multiple agencies in coordinated service locations. 14 4. By January 1 of each year, the department of human 15 services shall submit an annual written report to the 16 legislative fiscal committee and the general assembly’s 17 standing committees on government oversight concerning the 18 activities of the grant program during the previous fiscal 19 year. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill creates a disaster case management grant fund and 24 program. 25 The bill replaces provisions relating to disaster case 26 management with a disaster case management fund. Moneys in the 27 fund may be used by the executive council and may be expended 28 following the governor’s proclamation of a state of disaster 29 emergency or the declaration of a major disaster by the 30 president of the United States. The bill allows the executive 31 council to make financial grants to meet disaster-related 32 case management needs of disaster-affected individuals.
