H.J.R. 5 Section 1. The following amendment to the Constitution of 1 the State of Iowa is proposed: 2 Article VII of the Constitution of the State of Iowa is 3 amended by adding the following new section: 4 Sales tax. SEC. 11. The fund created by the general 5 assembly for the construction, maintenance, and supervision of 6 the public highways exclusively within the state as provided in 7 section 8 of this article shall be annually credited with the 8 amount generated by a sales tax rate of one-half of one percent 9 as may be imposed by the state upon the retail sales price of 10 tangible personal property and the furnishing of enumerated 11 services sold in this state that remain after any transfers 12 of sales tax revenues required by law of this state in effect 13 on the date of ratification of this amendment to local school 14 districts to be used solely for school infrastructure purposes 15 or school district property tax relief and that remain after 16 any transfers of sales tax revenues required by law of this 17 state in effect on the date of ratification of this amendment 18 to the natural resources and outdoor recreation trust fund 19 created under section 10 of this article. 20 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 21 amendment to the Constitution of the State of Iowa is referred 22 to the general assembly to be chosen at the next general 23 election for members of the general assembly, and the secretary 24 of state is directed to cause the proposed amendment to be 25 published for three consecutive months previous to the date of 26 that election as provided by law. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This joint resolution proposes an amendment to the 31 Constitution of the State of Iowa relating to funding for 32 the construction, maintenance, and supervision of the public 33 highways. 34 The joint resolution provides that the amount generated by 35 -1- LSB 2047YH (6) 86 ns/sc 1/ 2
H.J.R. 5 a sales tax rate of one-half of 1 percent as may be imposed by 1 the state shall be deposited in the fund created by the general 2 assembly for the construction, maintenance, and supervision 3 of the public highways, as provided in article VII, section 8 4 of the Constitution of the State of Iowa, after any transfers 5 of state sales tax revenues required by law in effect on 6 the date of ratification of the amendment to local school 7 districts to be used solely for school infrastructure purposes 8 or school district property tax relief and after any transfers 9 of sales tax revenues required by law in effect on the date 10 of ratification of this amendment to the natural resources 11 and outdoor recreation trust fund created under Article VII, 12 section 10 of the Constitution of the State of Iowa. 13 The joint resolution, if adopted, would be published and 14 then referred to the next general assembly (87th) for adoption 15 a second time, before being submitted to the electorate for 16 ratification. 17 -2- LSB 2047YH (6) 86 ns/sc 2/ 2
