H.F. 86 Section 1. Section 232.99, subsection 4, Code 2015, is 1 amended to read as follows: 2 4. a. When the dispositional hearing is concluded the 3 court shall make the least restrictive disposition appropriate 4 considering all the circumstances of the case. 5 b. The dispositions which may be entered under this division 6 are listed in sections 232.100 to 232.102 in order from least 7 to most restrictive. 8 c. In making a disposition under this section, the court 9 shall give primary consideration to the right of the child to 10 be safe and protected and the right to the best placement for 11 furthering the long-term nurturing and physical and emotional 12 health of the child. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill provides that in making a disposition upon an 17 adjudication of a child to be a child in need of assistance, 18 the court shall give primary consideration to the right of 19 the child to be safe and protected and the right to the best 20 placement for furthering the long-term nurturing and physical 21 and emotional health of the child. 22 -1- LSB 1377YH (3) 86 rh/rj 1/ 1
